H.R. 7673 — To amend the Organic Act of Guam to provide an exception to the "public purpose" requirement for certain land transfers in the case of a transfer restoring such land to the original landowner or heirs, and for other purposes.

This section amends Section 1 of the Act of November 13, 2000 (P.L. 106-504; 40 U.S.C. 521 note)—which authorizes the transfer of excess federal real property to the Government of Guam for public purposes under subsection (b)—by adding a new subsection (g) that exempts such transfers from the public purpose requirement if Guam subsequently conveys the property to the original landowner or the landowner's heirs. The section further requires the Government of Guam, not later than 180 days after enactment, to (1) establish a process for implementing subsection (g) and (2) submit a report describing the process to the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources. Additionally, the section designates any sale of property received under subsection (g) by the recipient to a foreign person—other than an heir of the original landowner—as a covered transaction under section 721 of the Defense Production Act of 1950 (50 U.S.C. 4565), requiring the Committee on Foreign Investment in the United States (CFIUS) to initiate a review.
