H.R. 7709 — Full-Body Restraint Prohibition Act

This section establishes prohibitions on the Department of Homeland Security (DHS) with respect to full-body restraints (i.e., four- or five-point restraints that immobilize an individual). Specifically, the Secretary of Homeland Security may not obligate or expend federal funds to acquire such restraints or utilize them, subject to a saving provision exempting contracts entered into on or before enactment. The section further requires the Secretary to remove from federal service any DHS officer or employee who violates these prohibitions or deceives Congress or departmental leadership on related matters. Additionally, the section directs DHS to submit reports to the House and Senate Committees on Homeland Security and the Judiciary, and the Senate Committee on Homeland Security and Governmental Affairs—not later than 90 days after enactment and quarterly thereafter—detailing departmental compliance and an accounting of any full-body restraints in DHS possession. (Thus, reports on utilization violations must include incident details such as the affected individual's demographics, citizenship or immigration status, restraint duration and location, personnel involved and their qualifications, and injury outcomes.) The section includes a conforming amendment to the table of contents of the Homeland Security Act of 2002.
