H.R. 772 — Rural ER Access Act

This section directs the Secretary of Health and Human Services, not later than 60 days after enactment, to revise Medicare regulations to remove the requirement that an off-campus facility or organization be located within a 35-mile radius of a hospital or critical access hospital campus to qualify for provider-based status. (Provider-based status allows such facilities to bill Medicare under the hospital outpatient prospective payment system—typically at higher rates—rather than the physician fee schedule.)
