H.R. 7743 — Stop ICE Intimidation Act of 2026

This section prohibits the Secretary of Homeland Security, beginning 30 days after enactment of this Act and until submission of a required report to specified congressional committees, from obligating appropriated funds for (1) operating biometric or other surveillance systems, including the Intelligence Records System of U.S. Immigration and Customs Enforcement (ICE); (2) entering or continuing contracts for such systems; or (3) hiring additional ICE officers, agents, or employees. The report must set forth an ICE policy governing use of such systems in immigration enforcement and removal operations that (A) prohibits accessing or storing information collected during exercise of constitutional rights; and (B) specifies rules for information use, access authorization, storage protections, retention and deletion periods, notice and contest procedures, exclusion of First Amendment-protected activities from "credible threat activity," definitions of credible threats against ICE, system costs and contracts, compliance with local privacy laws, and relevant training. This section further requires deletion, within 30 days of enactment, of information collected by immigration officers for such systems from January 1, 2026, through the date of enactment, unless the Secretary establishes the required policy by rule (including interim final rulemaking).

This section prohibits the use of funds appropriated to the Secretary of Homeland Security to restrict individuals from recording or documenting immigration enforcement or removal operations, provided such recording does not interfere with or obstruct those operations.
