This section prohibits states from issuing or renewing a commercial driver's license (CDL), including non-domiciled CDLs, or other authorization to operate a commercial motor vehicle (CMV) unless the individual is a U.S. citizen, lawful permanent resident, or nonimmigrant in possession of a valid, unexpired E-2, H-2A, or H-2B visa (amending 49 U.S.C. 31311(a)(12)); establishes a lifetime disqualification from operating a CMV for individuals lacking such status (with limited exceptions for B visa holders or those with valid ESTA admission), amending 49 U.S.C. 31310; and requires states to recertify all existing CDL holders within 180 days of enactment—including verification of eligible immigration status, English proficiency per 49 C.F.R. 391.11(b)(2), and passage of knowledge/skills tests in English—with revocation for failures and withholding of all federal funding to noncompliant states. (As background, CDLs, governed by 49 U.S.C. 31301 et seq., are required to operate CMVs, such as vehicles with a gross vehicle weight rating of 26,001 pounds or more, those transporting 16+ passengers, or hazardous materials.)
