H.R. 7764 — National Threat Evaluation and Reporting Program Reassignment and Funding Reform Act of 2026

This section states congressional findings on the National Threat Evaluation and Reporting (NTER) Program of the Department of Homeland Security (DHS). Specifically, Congress finds that (1) the NTER Program equips State, local, Tribal, and territorial (SLTT) partners to identify, assess, and report threats of targeted violence; (2) the program primarily serves non-Federal stakeholders and is operationally distinct from national intelligence priorities; (3) the DHS Office of State and Local Law Enforcement (OSLLE) is best positioned to manage the program; and (4) funding the program through National Intelligence Program (NIP) appropriations is inconsistent with its mission and scope.

This section directs the Secretary of Homeland Security to transfer the National Threat Evaluation and Reporting (NTER) Program—which builds threat assessment and management capabilities at state, local, tribal, and territorial levels to prevent targeted violence—from the Office of Intelligence and Analysis (I&A) to the Office for State and Local Law Enforcement (OSLLE) no later than 180 days after enactment, including necessary personnel, assets, and funds while ensuring operational continuity, SLTT partner engagement, and no reduction in program capabilities or services. The section further (1) prohibits use of National Intelligence Program (NIP) funds for the NTER Program after the transfer's effective date; (2) requires identification and allocation of alternative non-NIP funding sources (e.g., state and local programs or preparedness grants) for continued NTER operations and expansion under OSLLE; and (3) requires reports to the House Committee on Homeland Security and Senate Committee on Homeland Security and Governmental Affairs on transfer progress, operational impacts, funding adjustments, and challenges, initially due 120 days after enactment and every 180 days thereafter for two years.
