This section revises the formula in 23 U.S.C. 104(c) for calculating state shares of combined apportionments for the national highway performance program (sec. 119), surface transportation block grant program (sec. 133), highway safety improvement program (sec. 148), congestion mitigation and air quality improvement program (sec. 149), national highway freight program (sec. 167), carbon reduction program (sec. 175), PROTECT program subsection (c) (sec. 176), and metropolitan planning (sec. 134) for FY2026 and each fiscal year thereafter. (These programs provide formula funding to states for highway preservation and construction, safety improvements, air quality mitigation, freight mobility, emissions reductions, protective infrastructure, and urban planning.) The revised formula (1) sets each state's initial amount as its proportionate share of FY2012 apportionments multiplied by the total amount available; and (2) adjusts initial amounts upward as needed to ensure no state receives less than 95% of the product of the total amount available and the state's applicable percentage (i.e., its share of estimated Highway Trust Fund tax payments—other than Mass Transit Account—from highway users in the most recent fiscal year with data). On October 1 of each fiscal year, the Secretary apportions authorized amounts for the listed programs in accordance with this formula.
