This section deems employees of tribally controlled schools—as defined in section 5212 of the Tribally Controlled Schools Act of 1988 (25 U.S.C. 2512) and operating under contracts pursuant to the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5301 et seq.) or grants under the Tribally Controlled Schools Act of 1988 (25 U.S.C. 2501 et seq.)—to be employees under 5 U.S.C. 8401 for purposes of Federal Employees Retirement System (FERS) annuities (subchapter II, chapter 84, title 5, U.S. Code) and the Thrift Savings Plan (TSP) (subchapter III). Directs the Bureau of Indian Affairs to pay required government contributions under FERS and TSP and permits such employees to elect to opt out of coverage.
