This section prohibits states from issuing a commercial driver's license (CDL), non-domiciled CDL, or other authorization to operate a commercial motor vehicle (CMV) to an individual who is not a U.S. citizen, lawful permanent resident, or nonimmigrant with a valid, unexpired E-2, H-2A, or H-2B visa, by amending the list of disqualifying conditions in 49 U.S.C. 31311(a)(12). It establishes a lifetime disqualification from operating a CMV for such individuals, with exceptions for those holding valid B visas or Visa Waiver Program travel authorizations, by adding new subsection (l) to 49 U.S.C. 31310. To avoid withholding of federal funding, it requires each state to recertify all existing CDL holders within 180 days of enactment—verifying U.S. citizenship or lawful permanent residency or valid E-2, H-2A, or H-2B visa status, English proficiency per 49 C.F.R. 391.11(b)(2), and passage of knowledge and skills tests in English—and to revoke any such licenses for individuals who fail to recertify or meet these criteria.
