H.R. 7795 — VA SUBCON Act

This section requires the Secretary of Veterans Affairs, acting through the Director of Small and Disadvantaged Business Utilization, to establish and maintain a database of Small Business Administration-certified small business concerns owned and controlled by veterans (VOSBs), distinguishing between those owned and controlled by veterans with service-connected disabilities (SDVOSBs) and other VOSBs, to assist the Department in meeting its VOSB and SDVOSB prime and subcontracting goals under 38 U.S.C. §8127(a)(1) and its required review mechanism under §8127(a)(4). The database excludes mentor-protégé program participants, joint ventures, and small business concerns without at least two past prime contracts rated "Satisfactory" or better in the Contractor Performance Assessment Reporting System (CPARS); it must be made available to other-than-small business offerors on Department of Veterans Affairs (VA) contracts, including subcontracts, for use in required small business subcontracting plans. Within 180 days of establishment, the Secretary must report to the congressional Committees on Veterans' Affairs on database availability and usage, the number of VOSBs and SDVOSBs selected as VA subcontractors since establishment, and recommendations to increase utilization. Implementation must use existing VA personnel, systems, and funds with no new appropriations or organizational entities, and the provision sunsets on December 31, 2028.
