H.R. 78 — Pregnant Women Health and Safety Act of 2025

This section renames chapter 74 of title 18, United States Code—previously titled "Partial-Birth Abortions"—to "Abortions" and establishes a new criminal prohibition (§1532) making it unlawful for a physician to perform an abortion, in or affecting interstate or foreign commerce, without (1) admitting privileges at a hospital within 15 miles of the physician's principal medical office and the abortion location and (2) notifying the patient of that hospital location for follow-up care if complications arise. Violations are punishable by fine, imprisonment for not more than two years, or both; a woman upon whom an abortion is performed may not be prosecuted under the section, for conspiracy to violate it, or for aiding or abetting such a violation.

This section requires abortion clinics, as a condition for receiving federal funds or assistance, to (1) be licensed by the state in which located and (2) comply with requirements for ambulatory surgical centers (ASCs) under Medicare (title XVIII of the Social Security Act), except any relating to a certificate of need for state licensing. It authorizes a state board of health to waive certain structural requirements for ASC compliance, as determined appropriate by the Secretary of Health and Human Services. The section defines an abortion clinic as a facility, other than a hospital or ASC, in which first-, second-, or third-trimester abortions are performed during any 12-month period.
