H.R. 780 — Alexandra’s Law Act of 2025

This section establishes an advisory statement requirement in the Controlled Substances Act (21 U.S.C. 841) for convictions under that section involving fentanyl (N-phenyl-N-[1-(2-phenylethyl)-4-piperidinyl] propanamide) or an analogue thereof exchanged for value that result in death. Specifically, it (1) states that such persons may be charged with homicide; (2) requires courts to advise the convicted person that illicit drugs, especially when mixed with fentanyl, are deadly and that future distribution knowing or should-knowing of fentanyl content may result in federal murder or manslaughter charges (18 U.S.C. 1111 or 1112); (3) permits prior such convictions or pleas, or substantially similar state court advisements, as evidence of the defendant's knowledge in subsequent federal homicide prosecutions (and vice versa for federal advisements in state courts); and (4) exempts prosecutions of individuals who were minors when committing the prior offense. (Thus, the provision facilitates homicide charges against repeat fentanyl distributors by establishing a warning mechanism and evidentiary use of prior drug convictions resulting in death.)
