H.R. 7803 — Save Medicare Act

This section renames the Medicare Advantage program (Part C of Medicare, under which beneficiaries may enroll in private plans to receive Medicare Parts A and B benefits, and potentially additional benefits) as the Alternative Private Health Plan program and deems all statutory references to part C, Medicare+Choice, Medicare Advantage, or MA to refer to it. The Secretary of Health and Human Services must implement an orderly transition in terminology, fully completed for plan years beginning on or after October 15, 2023 (with prior references deemed to include the prior names).

This section establishes a civil money penalty of $100,000 for each instance in which an entity advertises a Medicare Advantage plan (Part C of title XVIII of the Social Security Act) by using the term "Medicare" in the plan title on or after the date of enactment. The provision applies the procedures of subsections (c), (g), and (h) of Section 1128A to such penalties in the same manner as to penalties under subsection (a).
