This section prohibits states and political subdivisions from sending, distributing, or providing unsolicited mail-in ballots for federal elections and requires individuals to submit a written or electronic request—affirming under penalty of perjury that they meet one or more of 13 eligibility criteria—to receive one. The eligibility criteria include (1) active-duty uniformed services members or their spouses/dependents; (2) out-of-county college students, instructors, or professors or their accompanying spouses/dependents; (3) out-of-county clergy or their accompanying spouses/dependents; (4) voters expecting temporary absence during early voting and on election day; (5) voters who moved more than 100 miles after voter registration closes; (6) voters involuntarily confined for mental treatment outside their county; (7) overseas residents; (8) voters expecting or undergoing unanticipated hospitalization; (9) participants in former state disability voting programs; (10) non-felony incarcerated voters; (11) address confidentiality program participants; (12) voters with documented disabilities; and (13) voters aged 65 or older. States may maintain lists of previously qualified voters only if they continue to meet the criteria under state law. The section applies to federal elections occurring on or after enactment.
