H.R. 7895 — PBM Kickback Prohibition Act

This section prohibits a covered service provider furnishing pharmacy benefit management services to a covered plan from paying, directly or indirectly, compensation to a brokerage firm, broker, consultant, advisor, or other individual for referring the plan's or a health insurance issuer's business to the service provider. The prohibition applies for plan years beginning after the date of enactment.
