This section prohibits removal from the United States of covered aliens—temporary protected status (TPS) holders under INA §244 (8 U.S.C. 1254a) on the date of enactment who work in or receive training for an essential industry (e.g., health care, agriculture, construction, sanitation, food services, transportation), a region with documented labor shortage (as determined by the Secretary of Labor), or a health care-related profession in a health professional shortage area (as determined by the HRSA Administrator)—notwithstanding termination of TPS. This section authorizes such covered aliens to adjust to lawful permanent resident status under INA §245 (8 U.S.C. 1255) beginning 90 days after enactment.
