H.R. 790 — To amend title 38, United States Code, to authorize an individual who is awarded the Purple Heart for service in the Armed Forces to transfer unused Post-9/11 Educational Assistance to a family member, and for other purposes.

This section establishes authority for veterans awarded the Purple Heart after discharge or release for Armed Forces service on or after September 11, 2001, to transfer up to 36 months of unused Post-9/11 GI Bill educational assistance to one or more eligible dependents (i.e., as defined in 10 U.S.C. §1072(2)(A), (D), and (I), generally including spouse, child, and individual in legal custody). Transferred entitlement is charged against the transferor's benefits on a month-for-month basis, paid at the same rates, revocable at any time, not divisible as marital property, usable by children after age 18 or high school completion but not after age 26 (without regard to the 15-year delimiting date), and unaffected by the transferor's death (with undistributed entitlement automatically allocated among eligible designated transferees).
