H.R. 7924 — Trucking Security and CCP Disclosure Act of 2026

This section establishes a certification requirement prohibiting the award or performance of Department of Defense (DoD) motor carrier contracts for cargo transportation—including those awarded by the United States Transportation Command or Military Surface Deployment and Distribution Command—unless the covered carrier certifies, to the best of its knowledge after reasonable inquiry, that it is not owned or controlled by, or does not have significant business relationships with, any entity on the most recent list of Chinese military companies under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (10 U.S.C. 113 note). The requirement applies to prime contractors, subcontractors, and owner-operators at all tiers, with flow-down obligations in subcontracts and lease agreements; covered carriers must retain certification records for at least five years; and knowing false certifications trigger suspension or debarment from DoD contracting and civil penalties under 18 U.S.C. 1001. The Secretary of Defense must issue implementing regulations within 180 days of enactment, including integration into Military Surface Deployment and Distribution Command carrier approval processes.

This section establishes a Secure Defense Freight Carrier Registry of motor carriers approved to transport freight for the Department of Defense by inserting a new chapter 140 in subtitle IV of title 49, United States Code. Not later than one year after enactment, the Secretary of Transportation, acting through the Federal Motor Carrier Safety Administration Administrator and in coordination with the Secretary of Defense, shall establish and maintain the registry. To be included, a motor carrier must (1) hold valid operating authority from the Federal Motor Carrier Safety Administration, (2) meet applicable Department of Defense carrier qualification standards, (3) undergo enhanced national security vetting—including screening for ownership, control, or significant business relationships with entities on the list maintained by the Department of Defense under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (10 U.S.C. 113 note) or other foreign adversary entities designated by the Secretary of Defense, and verification that drivers and personnel with access to Department of Defense freight meet security standards comparable to Transportation Worker Identification Credential programs—and (4) submit to periodic revetting at least every two years. The Secretary of Transportation shall establish a streamlined application process that coordinates with existing Department of Defense carrier approval systems. Beginning one year after enactment, a motor carrier may not bid on or perform a Department of Defense freight transportation contract unless included in the registry, subject to waivers by the Secretary of Defense for exigent circumstances.
