This section deems consumer products containing nitrous oxide (i.e., N₂O, also known as laughing gas or whippits) to be banned hazardous products under the Consumer Product Safety Act (15 U.S.C. 2057), effective 180 days after enactment. The ban does not apply to such products sold for use in (1) medical or dental treatment by licensed professionals, (2) commercial food production (including in manufacturing settings or commercial kitchens, defined as commercial restaurants, caterers, or other food preparation businesses), (3) research and development by accredited academic institutions, businesses, nonprofits, or government agencies, or (4) as a food propellant in pressurized containers.
