H.R. 795 — Pregnancy Is Not an Illness Act of 2025

This section prohibits the Department of Health and Human Services, including the Food and Drug Administration, from treating pregnancy as an illness for purposes of approving abortion drugs under section 505 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355) or imposing or maintaining any risk evaluation and mitigation strategy (REMS) for such drugs under section 505-1 (21 U.S.C. 355-1). It nullifies any prior approval of an abortion drug that relied in whole or in part on such treatment, including the approval of mifepristone in effect prior to enactment.
