H.R. 7967 — Heidi’s Law

This section directs the Secretary of Health and Human Services, not later than 90 days after enactment, to revise the Mandatory Guidelines for Federal Workplace Drug Testing Programs—standards for testing executive branch employees for drug use established pursuant to section 503(a) of Public Law 100-71 (5 U.S.C. 7301 note)—to expand the opiate category to include methadone and, upon completion, to publish a final notice of the revision in the Federal Register.

This section directs the Secretary of Transportation to issue, not later than 60 days after publication of the final notice required under section 2(b), regulations updating procedures for transportation employee workplace drug and alcohol testing programs—covering safety-sensitive positions in aviation, highways, rail, and other modes—to include testing for methadone use in drug-testing panels, consistent with the Mandatory Guidelines for Federal Workplace Drug Testing Programs as revised by the Secretary of Health and Human Services under section 2.

This section requires the Secretary of Health and Human Services, on an annual basis, to review and if necessary revise the Mandatory Guidelines for Federal Workplace Drug Testing Programs—established pursuant to section 503(a) of Public Law 100-71 (5 U.S.C. 7301 note)—to expand the list of substances authorized for testing to include additional drugs. Upon completing any revision, the Secretary must publish a final notice in the Federal Register.

This section directs the Secretary of Transportation to issue, not later than 60 days after publication of the final notice required under section 4(b), regulations updating procedures for transportation employee workplace drug and alcohol testing programs (i.e., for safety-sensitive positions in aviation, highways, railroads, mass transit, pipelines, and maritime) to include testing for newly identified substances in drug-testing panels, consistent with the Mandatory Guidelines for Federal Workplace Drug Testing Programs as revised by the Secretary of Health and Human Services under section 4.
