This section renames Chapter 74 of title 18, U.S. Code—from “Partial-Birth Abortions” to “Abortion Crimes”—and establishes a new criminal offense under section 1532 prohibiting any person, in or affecting interstate commerce, from providing or attempting to provide a chemical abortion drug (i.e., mifepristone, misoprostol, or substantially similar drugs) without (1) physically examining the patient, (2) being physically present at the location of the chemical abortion, and (3) providing a catch kit and red bag medical waste with instructions for the patient to return them to the health care provider for disposal. A violation is punishable by up to 5 years imprisonment, a fine of up to $50,000, or both, per occurrence. The section defines key terms, including “abortion” (i.e., using any drug or means to terminate a pregnancy knowing it will with reasonable likelihood cause the death of the unborn child, from fertilization to live birth, excluding acts to save the unborn child's life or health, remove a dead fetus from spontaneous abortion, or treat an ectopic pregnancy).
