H.R. 799 — Parental Notification and Intervention Act of 2025

This section makes it unlawful for any person or organization in or affecting interstate commerce or receiving federal funds to perform, permit the use of its facilities for, or assist in performing an abortion on an unemancipated minor under 18 without (1) providing written notification to the minor's parents (i.e., legal guardians; court waiver permitted only upon clear and convincing evidence of physical abuse by the parent), delivered personally or by certified mail to the parent's dwelling with return receipt requested and delivery restricted to the parent; (2) complying with a 96-hour waiting period after parental receipt of notice; and (3) complying with any injunction under section 3. Violations are punishable by a fine of up to $100,000, imprisonment for up to one year, or both, with an exception for medical emergencies certified by a physician (other than the performing physician) and documented in the minor's medical records.

This section authorizes a parent notified under section 2 of an intended abortion on an unemancipated minor to bring an action in the federal district court where the parent resides or the minor is located to enjoin the abortion. The court must issue a temporary injunction barring the abortion until the matter is fully adjudicated, and must issue a permanent injunction unless doing so would be unlawful.

This section provides that the Act does not preempt state laws establishing greater parental notification requirements or intervention rights regarding abortion than those provided under the Act.

This section provides that the Act takes effect upon enactment and declares its provisions severable, such that a finding of unconstitutionality as to any provision or application does not affect the remaining provisions or applications.
