§2.Elimination of diversity, equity, and inclusion in Federal Government
This section directs the Director of the Office of Management and Budget (OMB), assisted by the Attorney General and Director of the Office of Personnel Management (OPM), to coordinate the termination of all diversity, equity, and inclusion (DEI) and diversity, equity, inclusion, and accessibility (DEIA) mandates, policies, programs, preferences, and activities throughout the federal government. It requires the OPM Director, with Attorney General assistance as requested, to review and revise federal employment practices—including performance reviews, union contracts, and training—to eliminate DEI/DEIA factors and prioritize individual initiative, skills, performance, and hard work.
Within 60 days of enactment, each agency head, in consultation with the Attorney General, OMB Director, and OPM Director as appropriate, must (1) terminate, to the maximum extent allowed by law, all DEI/DEIA and "environmental justice" offices, positions (including Chief Diversity Officer positions), equity action plans, initiatives, grants, contracts, and performance requirements; (2) provide OMB with lists of all such preexisting positions, programs, budgets, expenditures (including any post-November 4, 2024 relabeling), DEI contractors since unspecified date, and DEI grantees since January 20, 2021; and (3) direct the deputy agency head to assess DEI program impacts and costs (including new hires) and recommend aligning agency activities—including policies, contracts, grants, enforcement, and litigation—with a policy of equal dignity and respect, potentially via notifications to Congress under 28 U.S.C. 530D (requiring Attorney General reports on DOJ non-enforcement or constitutional challenges to federal laws). (Thus, agencies must provide deputy heads necessary authority and resources.)
This section further requires the Assistant to the President for Domestic Policy to convene monthly meetings with the OMB and OPM Directors and all deputy agency heads to report on DEI prevalence and costs, discuss implementation barriers, and identify further actions; and includes a severability clause.
