H.R. 8013 — Keep Innovators in America Act

This section revises the definition of a nonimmigrant student (F-1 visa) in INA Section 101(a)(15)(F)(i) to allow a full course of study to include practical training and employment authorization under terms set by the Secretary of Homeland Security, if the employment is related to the student's field of study—including after completion of degree requirements. The revision further permits such students to maintain F-1 status as beneficiaries of a pending or approved employment-based immigrant petition under INA Section 204(a)(1), provided that as an enrolled student the course of study complies with INA Section 214(m) (which limits post-completion optional practical training to 12 months, or 36 months for STEM fields).
