H.R. 8030 — DPA Transparency Act of 2026

This section prohibits assistance under Title III of the Defense Production Act of 1950—i.e., loans, loan guarantees, purchases, and other financial support to expand production of defense-critical materials—from any covered entity. A covered entity is one in which a covered individual directly or indirectly holds a significant interest (not less than 20%, by vote or value, of any class of equity interest), with securities owned by two or more related covered individuals aggregated; covered individuals include the President, Vice President, or a member of the Defense Production Act Committee and their spouse, child, son-in-law, or daughter-in-law.

This section increases specified monetary penalties under the Defense Production Act of 1950 to $100,000 (from $10,000)—(1) in section 103; (2) in section 705, each place it appears; and (3) in section 710(f). (The act authorizes the President to prioritize production and allocation of materials and services for national defense purposes, with these penalties applying to violations of related orders and regulations.)

This section amends requirements for the annual report of the Defense Production Act Committee—which coordinates federal agencies' use of priorities and allocations authorities under the Defense Production Act (50 U.S.C. 4565 et seq.)—to include (1) a summary of steps taken to reduce fraud in transactions under the act and (2) a fraud risk assessment for all activities under the act. The section further directs the committee, not later than one year after enactment, to (1) establish and implement processes and procedures consistent with the Government Accountability Office's "A Framework for Managing Fraud Risks in Federal Programs" (GAO-15-593SP, July 28, 2015) to combat fraud in transactions under the act; (2) train personnel on those processes and procedures; and (3) designate a point of contact responsible for managing fraud issues, including coordination with agencies.

This section corrects a typographical error in the short title of the Defense Production Act of 1950 (i.e., striking “cited as “the Defense” and inserting “cited as the “Defense”), effective as of the date of the Act's original enactment.
