H.R. 8041 — Supporting VA Families Act

This section establishes an entitlement to four administrative weeks of unpaid parental leave during any 12-month period (expiring at the end of the 12-month period beginning on the qualifying birth or placement) for Department of Veterans Affairs (VA) employees, including those appointed full-time in Veterans Health Administration (VHA) positions listed in 38 U.S.C. 7421(b) (e.g., physicians, dentists, nurses). (Thus, this overrides the Secretary's authority under 38 U.S.C. 7421(a) to prescribe by regulation the leaves of absence for such employees.) This entitlement supplements, rather than supplants, leave available under subchapter V of 5 U.S.C. chapter 63 (federal unpaid parental leave) or 38 U.S.C. 7425(c), and incorporates definitions of "employee" and "son or daughter" from 5 U.S.C. 6831.
