H.R. 8043 — Vets CLEAR Act

This section amends the Department of Veterans Affairs Medical Care Collections Fund (MCCF) as follows: (1) expands sources of amounts deposited in the fund by adding recoveries under debt collection authorities (31 U.S.C. §§ 3711, 3729–3733) and through administrative, legal, or judicial processes—including investigations and audits—to the extent related to medical care, services, or medication furnished or paid for by the VA; (2) authorizes the VA Secretary, at discretion and notwithstanding other law, to deposit into the MCCF funds directed to the Medical Services account to reimburse costs of care furnished under 38 U.S.C. § 1781 (medical care for spouses and children of veterans) or § 8111 (health-care resource sharing with DoD), through September 30, 2028; and (3) requires the Government Accountability Office to submit reports to the congressional Veterans' Affairs Committees, not later than 180 days after enactment and semiannually thereafter while the new deposit authority is effective, detailing total funds deposited (disaggregated by source) and Department expenditures by category (e.g., medical care, services, staffing). (Thus, these changes increase available funds in the MCCF—used without fiscal year limitation for VA medical care and related collection expenses—and enhance transparency.)
