H.R. 8060 — Elder Justice Reauthorization and Modernization Act of 2026

This section reauthorizes and revises nursing home worker training grants under section 2041 of the Social Security Act. It entitles each state to an annual grant allotment based on its share of residents aged 65 or older or with disabilities (as defined in section 216(i)(1)), using the most recent American Community Survey data, subject to a 0.25 percent minimum and proportional adjustments to fully distribute available funds; redeterminations occur every 5 years, with post-FY2031 allotments limited to 90–110 percent of the prior year’s amount. The section reserves funds for grants to Indian tribes and tribal organizations operating eligible settings, authorizes subgrants to local organizations, and requires states to use funds for wage subsidies, tuition and licensing exam assistance, child care support, and transportation aid for eligible individuals working in nursing homes while permitting limited additional uses such as emergency reserves and paid leave support. States may reserve no more than 10 percent of grants for administration, technical assistance, and recruitment activities, must obligate funds within 2 years, and must submit annual reports on program activities.

This section requires the Secretary of Health and Human Services to submit a report not later than two years after enactment, and every two years thereafter, to the House Committee on Ways and Means and the Senate Committee on Finance and Special Committee on Aging on programs, coordinating bodies, registries, and activities under subtitle B of title XX of the Social Security Act or section 6703(b) of the Patient Protection and Affordable Care Act. Each report must include updates on independently conducted evaluations of access to and quality of resources to prevent, detect, and treat abuse, neglect, and exploitation of older adults and adults with disabilities, as well as recommendations on funding levels and policy changes. This section also amends section 2023 of the Social Security Act to require the Secretary to maintain adequate staffing and resources for the Office of Performance and Evaluation at the Administration for Community Living to conduct independent research and evaluation activities consistent with Department of Health and Human Services evaluation policy. This section appropriates $10,000,000 for each of fiscal years 2027 through 2030 to carry out these requirements.
