H.R. 8077 — 287(g) Cooperation Act of 2026

This section amends the 287(g) program—authorizing DHS to delegate specified immigration enforcement authority (i.e., powers under 8 U.S.C. 1357(a), such as interrogation and warrantless arrest of aliens) to state and local law enforcement officers pursuant to a memorandum of agreement—to (1) render any state or political subdivision maintaining a law enforcement agency ineligible for Community Oriented Policing Services (COPS) grants or any DOJ-administered successor program if the agency fails to enter such an agreement within 180 days after enactment of the 287(g) Cooperation Act of 2026; and (2) require the Attorney General, in consultation with the DHS Secretary, to establish procedures for verifying agency compliance before approving COPS grants.

This section specifies that the Act takes effect on the date of enactment and applies to grant applications under the Community Oriented Policing Services (COPS) program for FY2027 and each fiscal year thereafter.
