H.R. 8083 — Allowing Greater Access to Safe and Effective Contraception Act

This section directs the Secretary of Health and Human Services to give priority review to supplemental applications under section 505(b) of the Federal Food, Drug, and Cosmetic Act for oral contraceptive drugs intended for routine use (excluding emergency contraceptives and drugs approved for induced abortion) if approval would exempt such drugs from prescription requirements of section 503(b)(1) (i.e., drugs not safe for use except under supervision of a licensed practitioner) for individuals aged 18 and older. The section waives the prescription drug user fee under section 736(a)(1) for such applications and requires that approved drugs remain subject to section 503(b)(1) prescription requirements for individuals under age 18. This section applies to applications submitted before or after the date of enactment, including those pending on such date.

This section directs the Comptroller General to conduct a study and submit a report to Congress, not later than one year after enactment, on the amount of federal funds provided for contraception reimbursement, inventory stocking, provider training, or patient education during the 15-year period preceding enactment. The study covers such funding through (1) Medicare; (2) Medicaid; (3) the Indian Health Service; (4) American Health Benefit Exchanges under the Patient Protection and Affordable Care Act; (5) federally qualified health centers; (6) title X of the Public Health Service Act; (7) Temporary Assistance for Needy Families; or (8) TRICARE.
