H.R. 8094 — AI Foundation Model Transparency Act of 2026

This section directs the Federal Trade Commission (FTC), not later than one year after enactment and in consultation with the Director of the National Institute of Standards and Technology, the Secretary of Commerce, the Director of the Office of Science and Technology Policy, and specified stakeholders, to promulgate regulations and issue guidance establishing transparency requirements for covered entities with respect to foundation models (i.e., large AI models trained on broad datasets). The regulations require covered entities (1) to submit specified information on each foundation model to the FTC and (2) to publicly disclose certain information on their websites and a central FTC-hosted website in human-readable (for entity sites) and machine-readable (for FTC site) formats, including summaries of training data sources, collection, size, and composition; data governance procedures; intended purposes, risks, limitations, versions, knowledge cutoffs, edits, and adverse incident monitoring; supported languages; alignment efforts with NIST's AI Risk Management Framework or similar standards; benchmark performance on high-risk topics (e.g., medical advice, weapons, national security, elections); and computational power used for training and operations; with an option to comply via system or model cards. The regulations exempt fully open-source foundation models and, for downstream models derived from a compliant base model, require only a URL to the base model's disclosure plus compliance for significant changes, retraining, or adaptations.
