This section adds a new subsection (j) to Section 8 of the Commodity Exchange Act (CEA), which authorizes Commodity Futures Trading Commission (CFTC) investigations of boards of trade and others subject to the CEA and restricts publication of confidential data such as business transactions, market positions, trade secrets, and customer names. The new subsection requires the CFTC, after notice and comment, to adopt rules and regulations to (1) apply Section 8 provisions to proprietary information obtained or received by the CFTC (to the extent not already covered); (2) address circumstances for requesting such information, safeguard it based on sensitivity level, limit access to appropriate staff, and protect it from unlawful use or disclosure; and (3) govern sharing with other governmental entities, requiring assurances of safeguards consistent with specified protections under new subsection (j)(2) and CEA Section 8(e)(2)-(4).
