H.R. 8169 — Export Control Enforcement and Enhancement Act

This section establishes an expedited process for the End-User Review Committee (EURC)—established in the Export Administration Regulations (EAR) to review proposed additions to, removals from, or other modifications of the Entity List (i.e., a BIS-maintained list of foreign end-users reasonably believed to be involved in activities contrary to U.S. national security or foreign policy interests, generally subject to a policy of license denial)—as follows: (1) authorizes any EURC member to submit a proposal directly to the committee for a vote on Entity List additions, removals, or modifications, with additions requiring compliance with specified procedures; (2) requires the EURC to vote to approve or disapprove a proposal within 30 days of submission, subject to a possible 15-day suspension (with the proposer's concurrence) if the chair determines additional information is needed or unanimous agreement to postpone; (3) authorizes Entity List additions by majority vote upon a determination that an entity has engaged, is engaged, or is at risk of engaging in such activities, with a presumption of denial for related export licenses (unless a majority approves a different policy) that does not limit EAR escalation procedures; and (4) specifies administrative rules, including one vote per member (with no chair override), notice to the Assistant Secretary of Commerce for Export Administration for implementation, and definitions of relevant terms.
