H.R. 8173 — Reforming ICE and Protecting America Act

This section requires the Secretary of Homeland Security to submit to the Inspector General of the Department of Homeland Security, by October 15, 2026, a report listing all grants and contracts awarded by any means other than full and open competition during FY2025 or FY2026. The Inspector General must review the report for departmental compliance with applicable laws and regulations and report the results to the House and Senate Committees on Appropriations by February 15, 2027.

This section requires the Department of Homeland Security (DHS) Chief Financial Officer to submit to the House and Senate Appropriations Committees, not later than 30 days after the last day of each month, a budget and staffing report on total obligations for that month and the fiscal year to date at the appropriation and program, project, and activity levels by source year of appropriation. The initial such staffing report establishes the baseline for any DHS increases or decreases in staffing levels for programs, projects, or activities pursuant to section 503(a)(4).

This section requires the Secretary of Homeland Security, in consultation with the Secretary of the Treasury, to notify the House and Senate Committees on Appropriations of any proposed transfers of funds from the Department of the Treasury Forfeiture Fund to DHS agencies under 31 U.S.C. 9705(g)(4)(B). No such funds may be obligated until the committees are notified.

This section requires all official costs associated with the use of government aircraft by Department of Homeland Security personnel to support official travel of the Secretary and Deputy Secretary to be paid from amounts made available for the Office of the Secretary.

This section directs the Under Secretary for Management to brief the House and Senate Committees on Appropriations not later than 45 days after the end of each fiscal quarter on all Level 1 and Level 2 acquisition programs on the Department of Homeland Security's Master Acquisition Oversight List between Acquisition Decision Event and Full Operational Capability, including programs removed from the list during the preceding quarter. For each program, the briefing must include (1) a description of the program's purpose, capabilities acquired, and sponsoring component(s); (2) the total annual units to be acquired until procurement is complete under the current baseline; (3) Acquisition Review Board status, including current phase, most recent review date, and any pause or breach status; (4) a comparison of initial and current cost, schedule, and performance thresholds and objectives; (5) the lifecycle cost estimate adjusted for the Future Years Homeland Security Program, including confidence level, fiscal years covered, prior five years/current/budget year breakout, appropriation breakout, and changes from prior baseline; (6) findings of any independent verification and validation or an explanation for its absence; (7) a table of obligations by prior fiscal year, current-year estimate, and planned carryover; (8) prime contractors and major subcontractors; and (9) narrative descriptions of risks to cost, schedule, or performance that could cause a breach. The section further requires submission of each approved Acquisition Decision Memorandum for such programs to the committees not later than five business days after approval.

This section prohibits the Department of Homeland Security (DHS) from obligating funds appropriated in this Act or prior Acts for new pilot or demonstration programs unless the relevant component or office documents (1) well-defined and measurable objectives, (2) an assessment methodology detailing data types/sources, collection methods/frequency, and analysis, and (3) an implementation plan with milestones, cost estimates, schedules, and projected end date. Prior to obligating Operations and Support funds for such programs, the Under Secretary for Management must report this information to the House and Senate Appropriations Committees; within 90 days after program completion, the Under Secretary must report lessons learned, actual costs, and plans for expansion, continuation, or transition to an enduring program or operation. The section defines applicable pilots or demonstrations as small-scale, short-term experiments evaluating feasibility, duration, costs, or adverse events that use more than 10 full-time equivalents or obligate (or propose to obligate) $5 million or more, excluding congressionally directed programs or enhancements, programs operational as of enactment, information technology procurement testing/evaluation/initial deployment phases, and non-Federal recipient pilots under financial assistance agreements.

This section prohibits the Office of Intelligence and Analysis of the Department of Homeland Security from using funds appropriated by this Act to conduct a covered activity, as defined in section 6303 of the Intelligence Authorization Act for Fiscal Year 2025 (division F of Public Law 118–159). The prohibition does not limit Department of Homeland Security oversight of the office's intelligence activities for legal, privacy, civil rights, or civil liberties compliance and does not restrict the office's personnel from sharing or receiving intelligence information with foreign, state, local, tribal, or territorial governments (or their agencies or subdivisions); the private sector; or other federal government elements, including Department of Homeland Security components.

This section directs the Department's Inspector General to submit quarterly reports to the House and Senate Appropriations Committees on oversight of funds provided under Public Law 119–21, including (1) reviews of spend plans for all related programs, projects, or activities with obligated funds compared to projections, and (2) summaries of audits of related contracting, procurement, and acquisition activities. The section further requires annual comprehensive reports to the same committees, beginning one year after enactment, on audits, inspections, and evaluations of such funds and activities, including recommendations to improve effectiveness and efficiency and prevent waste, fraud, and abuse.

This section provides $20 million to the Department of Homeland Security (DHS) Office of the Secretary for procurement, deployment, and operations of body-worn cameras for agents and officers performing enforcement activities under the Immigration and Nationality Act (8 U.S.C. 1101 et seq.). It requires the DHS Secretary to submit to the House and Senate Appropriations Committees a spend plan for these funds within 30 days of enactment.

This section applies to funds made available by this Act the overtime compensation limitations established in sec. 201 of the Department of Homeland Security Appropriations Act, 2018 (i.e., restrictions on premium pay and overtime for DHS personnel), substituting fiscal year 2026 for fiscal year 2018.

This section makes funding available under the U.S. Customs and Border Protection (CBP) Operations and Support and Procurement, Construction, and Improvements accounts for customs expenses in Puerto Rico and the U.S. Virgin Islands when necessary to maintain operations and prevent adverse personnel actions, in addition to funding provided by 48 U.S.C. §§ 740 and 1406i.

This section makes fees collected from passengers arriving from Canada, Mexico, or an adjacent island pursuant to 19 U.S.C. 58c(a)(5)—i.e., the $1.75 per passenger fee under subsection (a)(5)(B)—available until expended.

This section provides $31 million, to remain available until expended, for U.S. Customs and Border Protection—Operations and Support, to be reduced by amounts collected and credited to this appropriation in FY2026 under section 286(i) of the Immigration and Nationality Act (8 U.S.C. 1356(i)), section 10412 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8311, authorizing reimbursable fee agreements for preclearance of animals or articles outside the United States), section 817 of the Trade Facilitation and Trade Enforcement Act of 2015 (Public Law 114-125), or other such authorities. Amounts collected in excess of $31 million are credited to this appropriation, to remain available until expended.

This section prohibits U.S. Customs and Border Protection from using appropriated funds to prevent individuals not in the business of importing from personally transporting a personal-use quantity (not to exceed a 90-day supply) of a prescription drug from Canada that complies with the Federal Food, Drug, and Cosmetic Act, provided the drug is not (1) a controlled substance, as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802), or (2) a biological product, as defined in section 351 of the Public Health Service Act (42 U.S.C. 262).

This section prohibits the use of appropriated funds to approve waivers of U.S. navigation and vessel-inspection laws (i.e., Jones Act requirements) under 46 U.S.C. §501(b) for transporting crude oil to or from the Strategic Petroleum Reserve until the Secretary of Homeland Security, after consulting the Secretaries of Energy and Transportation and U.S.-flag maritime industry representatives, ensures the use of U.S.-flag vessels. It further requires the Secretary to notify specified House and Senate committees within two business days of any such waiver requests and their dispositions.

This section prohibits the Secretary of Homeland Security, beginning on the date of enactment, from (1) establishing, collecting, or otherwise imposing any new border crossing fee on individuals crossing the southern or northern border at a land port of entry, or (2) conducting any study relating to the imposition of such a fee. It defines border crossing fee as a fee required of every pedestrian, cyclist, and driver and passenger of a private motor vehicle for crossing those borders at a land port of entry.

This section requires the Commissioner of U.S. Customs and Border Protection to submit to the House and Senate Appropriations Committees, not later than 90 days after enactment, an expenditure plan for amounts made available for U.S. Customs and Border Protection—Procurement, Construction, and Improvements in this Act and prior Acts. No such amounts provided in this Act may be obligated prior to submission of the plan.

This section permits funds appropriated by this Act to alter operations within the National Targeting Center of U.S. Customs and Border Protection (CBP). The section further prohibits the use of funds appropriated by this Act, by prior appropriations acts that remain available in FY2026, or from fee collections available to components funded by this Act from reducing anticipated or planned vetting operations (i.e., risk assessments of passengers, cargo, and conveyances) at existing locations unless authorized by a statute enacted after this Act.

This section prohibits the use of funds appropriated for U.S. Customs and Border Protection—Procurement, Construction, and Improvements for Border Security Assets and Infrastructure to procure or deploy surveillance systems that are not autonomous, as defined in section 90004 of P.L. 119-21.

This section directs the Secretary to ensure full implementation of the U.S. Customs and Border Protection (CBP) policy statement of November 30, 2021, titled "Policy Statement and Required Actions Regarding Pregnant, Postpartum, Nursing Individuals, and Infants in Custody"—or substantively similar standards developed in consultation with maternal and pediatric health providers and experts—to safeguard the health, safety, and rights of pregnant women in CBP custody.

This section prohibits the use of funds appropriated under the U.S. Immigration and Customs Enforcement (ICE)—Operations and Support heading to continue any delegation of immigration enforcement authority to state or local law enforcement under INA §287(g) (i.e., the 287(g) program, which allows DHS to enter written agreements authorizing designated state and local officers to perform specified immigration functions under federal supervision) if the Department of Homeland Security Inspector General determines a material violation of the agreement terms.

This section prohibits the use of funds appropriated for U.S. Immigration and Customs Enforcement (ICE) Operations and Support to continue contracts for detention services at facilities whose two most recent overall performance evaluations are less than “adequate” (or the equivalent median score in any subsequent evaluation system). The evaluations are conducted by ICE's Office of Professional Responsibility.

This section authorizes the Secretary to reprogram funds within and transfer funds to U.S. Immigration and Customs Enforcement—Operations and Support, without regard to time and condition limitations of section 503(d), as necessary to ensure detention of aliens prioritized for removal.

This section continues the semimonthly reports to Congress required under sec. 216 of the Department of Homeland Security Appropriations Act, 2021 (Division F, Public Law 116-260), applying all specified reporting matters (i.e., statistics on aliens apprehended or processed for removal at the southwest land border, including by family units and unaccompanied alien children) during the period described in that section.

This section directs the Director of U.S. Immigration and Customs Enforcement (ICE) to provide, within 30 days of enactment, a briefing and initial written obligation plan for all ICE funding under this or prior acts—delineated by month, level II program, project, and activity, and pay and non-pay requirements; incorporating all funding sources (including carryover balances and fees); and including data-driven assumptions for major contract costs, projected personnel levels, and operational and policy considerations. It further requires monthly briefings and written updates on the plan (due no later than 15 days after the beginning of the following month) covering, at a minimum: (1) actual obligations and expenditures (including prior year); (2) prior-year carryover balances; (3) resource and payroll projections for the fiscal year remainder; (4) contracts extending beyond the current fiscal year; (5) obligations and expenditures for domestic and international investigative missions (including countering fentanyl and child exploitation); (6) operations rates and fund exhaustion projections for Custody Operations, Alternatives to Detention, and Transportation and Removal Operations; and (7) the initial plan for comparison. Finally, this section provides $700,000 ($100,000 on the 16th day of each month) for ICE Operations and Support—Executive Leadership and Oversight, available beginning 30 days after enactment only if initial and monthly reporting requirements are met on time.

This section directs the Director of U.S. Immigration and Customs Enforcement (ICE) to submit to the House and Senate Appropriations Committees, not later than 90 days after enactment, a written execution plan for funding provided by Public Law 119–21 for detention facilities. The plan must include (1) the location, number of beds, and estimated cost per bed for each facility used in the preceding quarter; (2) the same details for facilities projected for the subsequent quarter; (3) the total number of beds projected through fiscal year-end; (4) associated increases or decreases in transportation and removal operations costs, including removal flights; and (5) an overview of the desired geographic end-state for facilities, new operational models or strategies for detention capacity, and a comparison of current versus projected capacity. Subsequent to the initial plan, ICE must provide a briefing and written update to the committees not later than 30 days after the end of each fiscal quarter, including a review of the prior quarter's fund execution, a comparison of actual versus planned execution, any remedial actions, and an unchanged display of the initial plan for comparison.

This section prohibits the use of appropriated funds to reduce the presence of U.S. Immigration and Customs Enforcement (ICE) attachés or liaisons at international U.S. embassies or consulates for international investigations or partnerships with foreign law enforcement. The prohibition does not apply to reductions in a specific country if (1) the Secretaries of Homeland Security and State provide the House and Senate Appropriations Committees a written explanation that maintaining such presence undermines U.S. foreign policy interests there, or (2) the host country requests cessation of those activities.

This section requires Members of the House and Senate (including leadership); heads of federal agencies and commissions (including the Secretary, Deputy Secretary, Under Secretaries, and Assistant Secretaries of Homeland Security); the Attorney General, Deputy Attorney General, Assistant Attorneys General, and U.S. Attorneys; and senior Executive Office of the President staff (including the Director of the Office of Management and Budget) to undergo federal passenger and baggage screening. It prohibits use of funds appropriated in this or any other Act—including prior Acts or fee collections available to components funded by this Act—to implement legislation altering these screening requirements.

This section authorizes the use of any available funds in the Aviation Security Capital Fund for FY2026, notwithstanding 49 U.S.C. 44923, for the procurement and installation of explosives detection systems or for other transaction agreements to fund airport security capital improvement projects described in section 44923(a) (i.e., replacing baggage conveyor systems related to aviation security, reconfiguring terminal baggage areas for explosive detection systems, deploying such systems in specified areas, or other security capital improvements).

This section directs the Transportation Security Administration (TSA) Administrator to submit to the House and Senate Committees on Appropriations and specified homeland security and transportation committees, not later than 45 days after the President's budget proposal, a single report that includes (1) a Capital Investment Plan, both constrained and unconstrained, for continuous and sustained investment in new and replacement transportation security equipment; (2) the 5-year technology investment plan required under section 1611 of title XVI of the Homeland Security Act of 2002, as amended by the Transportation Security Acquisition Reform Act (P.L. 113-245); and (3) the Advanced Integrated Passenger Screening Technologies report required by Senate Report 115-283 accompanying the FY2019 Department of Homeland Security Appropriations Act.

This section revises the requirement in Section 515(b) of P.L. 108-334—a note to 49 U.S.C. 44945—for the Transportation Security Administration to transmit a report to congressional committees by requiring the agency to provide a briefing instead (including changing the subsection heading from "report" to "briefing").

This section prohibits the use of Coast Guard—Operations and Support funds for expenses incurred in documenting recreational vessels under 46 U.S.C. §12114 (i.e., issuance of recreational endorsements allowing eligible vessels to operate only for pleasure, with limited customs entry requirements), except to the extent fees collected from owners of yachts are credited to that appropriation. If such fees are insufficient to cover those expenses and there is a backlog of recreational vessel applications, it authorizes personnel performing non-recreational vessel documentation to process recreational vessel documentation.

This section directs the Commandant of the Coast Guard to submit to the House and Senate Appropriations Committees a future-years capital investment plan (i.e., a multi-year plan for major acquisitions such as cutters, aircraft, and shore infrastructure) for the Coast Guard—Acquisition, Construction, and Improvements account, as described in the second proviso under that heading in the Department of Homeland Security Appropriations Act, 2015 (P.L. 114-4), and subject to the requirements in the third and fourth provisos under such heading.

This section prohibits the use of funds appropriated by this Act to conduct or implement a competition under Office of Management and Budget Circular A-76 (i.e., public-private competition policy for federal commercial activities) for activities performed with respect to the Coast Guard National Vessel Documentation Center.

This section authorizes the use of funds provided in this Act to alter operations within the Coast Guard Civil Engineering Program nationwide—including civil engineering units, facilities design and construction centers, maintenance and logistics commands, and the Coast Guard Academy—but prohibits using such funds to reduce operations within any civil engineering unit unless authorized by a statute enacted after the date of enactment of this Act.

This section provides that amounts deposited into the Coast Guard Housing Fund in FY2026 shall remain available until expended to carry out military family housing and unaccompanied housing activities under 14 U.S.C. 2946 (i.e., planning, environmental compliance, and conveyance of real property), in addition to funds otherwise available for such purposes.

This section provides $98 million, to remain available until September 30, 2030, for the Coast Guard—Procurement, Construction, and Improvements account to procure MQ-9 aircraft, associated base stations, related equipment, and program management. It prohibits the use of any Department of Homeland Security funds provided in this or prior acts to procure or acquire long-range unmanned aircraft with kinetic capabilities or to equip such aircraft with kinetic capabilities.

This section prohibits the obligation of funds appropriated by this Act for implementation of Coast Guard Force Design 2028 until the Coast Guard provides detailed briefings to the House and Senate Committees on Appropriations on initiatives related to organization, people, technology, and contracting and acquisitions.

This section authorizes the United States Secret Service to obligate funds in anticipation of reimbursements from executive agencies (as defined in 5 U.S.C. §105, i.e., an Executive department, a Government corporation, or an independent establishment) for personnel receiving training sponsored by the James J. Rowley Training Center. Total obligations at the end of the fiscal year may not exceed total budgetary resources available under the "United States Secret Service—Operations and Support" heading at the end of the fiscal year.

This section prohibits the use of appropriated funds by the United States Secret Service for the protection of the head of any federal agency other than the Secretary of Homeland Security. The Secret Service Director may enter into fully reimbursable agreements to provide such protection.

This section authorizes United States Secret Service Operations and Support funding provided in this Act for employee travel on protective missions without regard to expenditure limitations in this or any other Act, provided the Director or designee notifies the House and Senate Appropriations Committees at least 10 days in advance or as early as practicable.

This section provides $2 million, to remain available until expended, from United States Secret Service Operations and Support appropriations as a grant or cooperative agreement for existing National Computer Forensics Institute facilities used by the Secret Service to carry out activities under 6 U.S.C. 383. (As background, the Institute, authorized for FY2023 through 2028, educates, trains, and equips state, local, territorial, and Tribal law enforcement officers, prosecutors, judges, and certain cyber fraud task force participants on investigating and preventing cybersecurity incidents and electronic crimes.)

This section (1) limits aggregate basic pay and premium pay for United States Secret Service (USSS) personnel for 2024 to the Vice President's annual salary rate (retroactive to December 31, 2023); (2) requires the USSS Director to submit to specified congressional committees, within 180 days of enactment and annually through 2028, reports on steps to address increased protective service demands—including analyses of current operational demands and staffing levels and recommended overtime reduction strategies such as hiring additional personnel, ensuring year-round resources without premium pay waivers, workload redistribution, and operational efficiencies; (3) directs inclusion of average and range of overtime hours data for USSS personnel exceeding pay caps under 5 U.S.C. 5547(a) and under the Overtime Pay Protection Act of 2016 within reports required by the Overtime Pay for Protective Services Act of 2023; and (4) increases to $40 million (from $24 million) a specified funding amount available for USSS operations and support for 2024 (from 2023).

This section applies to funds made available by this Act the prohibition in sec. 211 of the Department of Homeland Security Appropriations Act, 2021 (division F of P.L. 116-260), which bars such funds from being used for construction of border fencing in certain areas (i.e., specific wildlife refuges and other environmentally sensitive lands along the U.S.-Mexico border).

This section permits funds appropriated under the "Cybersecurity and Infrastructure Security Agency—Operations and Support" heading to be used for the necessary expenses of procuring or providing access to cybersecurity threat feeds for federal government entities (i.e., branches, agencies, independent agencies, corporations, establishments, and instrumentalities), state, local, tribal, and territorial entities, fusion centers as described in section 210A of the Homeland Security Act of 2002 (6 U.S.C. 124h), and Information Sharing and Analysis Organizations (ISACs). (Fusion centers are state, local, and regional entities that DHS supports to gather, analyze, and share homeland security information.)

This section increases from 3% to 5% the maximum amount of certain Federal Emergency Management Agency (FEMA) grants that may be used for administrative expenses. The change applies notwithstanding existing law (6 U.S.C. 609(a)(12)) to grants available under paragraphs (1) through (5) in the FEMA—Federal Assistance account and extends the authority to state recipients administering grants under paragraph (3).

This section establishes deadlines for grants under specified Federal Emergency Management Agency (FEMA) Federal Assistance programs in paragraphs (1) through (5): applications must be made available to eligible applicants not later than 60 days after enactment of this Act, eligible applicants must submit applications not later than 80 days after the grant announcement, and the FEMA Administrator must act on applications within 65 days of receipt. It further reduces appropriations for FEMA Operations and Support by $100,000 for each day past the 60-day requirement that applications are not made available, with a corresponding reduction to Mission Support funding specified in the explanatory statement.

This section requires the FEMA Administrator to brief the House and Senate Appropriations Committees five full business days in advance of publicly announcing the intention to award grants under specified paragraphs—(1) through (5), (9), and (10)—of FEMA Federal Assistance. If such an announcement occurs beforehand, this section rescinds $1 million from amounts appropriated for FEMA Operations and Support, with a corresponding reduction to Mission Support funding specified in the Department of Homeland Security Appropriations Act, 2026 table.

This section specifies that, for Federal Emergency Management Agency Federal Assistance grants under paragraphs (1) and (2), the installation of communications towers is not considered construction of a building or other physical facility. (Thus, such installations are eligible for grant funding without restrictions applicable to new construction.)

This section extends to fiscal year 2026 (with respect to budget year 2027 and current fiscal year 2026, respectively) the reporting requirements for the Federal Emergency Management Agency's Disaster Relief Fund—(1) by substituting "fiscal year 2027" for "fiscal year 2016" in the report on projected needs; and (2) by inserting "business" after "fifth" in the report on obligations and expenditures. (The Disaster Relief Fund provides Stafford Act disaster assistance grants to state, local, tribal, and territorial governments.)

This section authorizes the Administrator of FEMA to waive specified requirements for Staffing for Adequate Fire and Emergency Response (SAFER) grants, including under subsection (a)(1)(A) the purposes of hiring grants (i.e., increasing firefighters to meet industry standards and 24-hour staffing); under subsection (a)(1)(B) the three-year grant term and uses limited to hiring additional firefighters or converting part-time or paid-on-call firefighters to full-time; under subsection (a)(1)(E) the cost-sharing requirements of 75 percent in the first two years and 35 percent in the third year; and under subsections (c)(1), (c)(2), and (c)(4). (Thus, the waivers apply to grants made under FEMA's Federal Assistance account.)

This section requires that fees assessed during FY2026 under the Radiological Emergency Preparedness Fund (42 U.S.C. 5196e)—which supports offsite radiological emergency planning, preparedness, and response activities around nuclear facilities—equal at least 100% of the Department of Homeland Security's (DHS) anticipated costs for its Radiological Emergency Preparedness Program in FY2027 (previously FEMA, for the assessment year). It further requires a fair and equitable fee methodology that reflects service costs, including administrative costs of collection, and directs that fees be deposited as offsetting collections in the program's account, available October 1, 2026, until expended (previously October 1, 1999).

This section authorizes the Administrator of FEMA to waive the Buy American requirement of subsection (k) of section 33 of the Federal Fire Prevention and Control Act of 1974 (15 U.S.C. 2229)—which generally prohibits use of Assistance to Firefighters Grant funds to purchase foreign-produced equipment, supplies, or materials absent a certification of impracticability—in awarding such grants.

This section transfers any unobligated balances from prior appropriations to the National Predisaster Mitigation Fund under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5133), as in effect before its amendment by section 1234 of division D of P.L. 115-254, into funds set aside under subsection (i)(1) of that section as currently in effect. (The predisaster mitigation program provides technical and financial assistance to states and local governments—or, in limited cases, directly to small impoverished communities—for cost-effective measures to reduce injuries, loss of life, and property damage from natural disasters.)

This section transfers any unobligated balances from prior appropriations under the heading "Federal Emergency Management Agency—Flood Hazard Mapping and Risk Analysis Program" to the "Federal Emergency Management Agency—Federal Assistance" account for necessary expenses of flood hazard mapping and risk analysis. (Thus, the transferred funds supplement appropriations from the National Flood Insurance Fund and any state or local cost-sharing for mapping activities under 42 U.S.C. 4101(f)(2) and remain available until expended.)

This section requires each grant award under the Federal Emergency Management Agency—Federal Assistance heading for paragraphs (1) through (10) and (12) to have a period of performance of not less than three years and not more than five years.

This section requires the Federal Emergency Management Agency (FEMA) Administrator to post an interactive dashboard on FEMA's public website displaying reimbursement requests for covered expenses related to emergency (42 U.S.C. 5122(1)) or major disaster (42 U.S.C. 5122(2)) declarations under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.), delineated by state and amounts for individual assistance or public assistance. The dashboard must be updated not more than 90 days after FEMA receives the information and not more than 60 days after final review by the Department of Homeland Security, and include at minimum the information listed in subparagraphs (1) through (7) under the "Public and Individual Assistance" heading in the explanatory statement described in section 4 (in the matter preceding division A of this Act).

This section prohibits the use of funds appropriated by this Act to pause any training or grant funded under the heading “Federal Emergency Management Agency—Federal Assistance” (i.e., FEMA grants to state, local, tribal, and territorial governments for emergency management preparedness, response, and recovery). The prohibition does not apply if the Secretary of Homeland Security notifies the House and Senate Appropriations Committees not more than 10 business days in advance of the pause—including an explanation, plans to make up any missed classes, and the budgetary impact—and the Secretary may waive the notice requirement in extraordinary circumstances imminently threatening human life or property.

This section authorizes U.S. Citizenship and Immigration Services (USCIS) to use available funds to acquire, operate, equip, and dispose of up to 5 replacement vehicles in areas where the General Services Administration does not provide vehicles for lease. It permits the USCIS director to authorize employees assigned to those areas to use such vehicles for travel between their residences and places of employment.

This section prohibits the use of funds appropriated by this Act to process or approve competitions under Office of Management and Budget Circular A-76 (i.e., public-private competitions for federal commercial activities) for services provided by specified employees of U.S. Citizenship and Immigration Services, including Immigration Information Officers, Immigration Service Analysts, Contact Representatives, Investigative Assistants, and Immigration Services Officers (including those serving on a temporary or term basis).

This section authorizes U.S. Citizenship and Immigration Services (USCIS) to use any available federal funds for the collection and use of biometrics (i.e., fingerprints, photos) at USCIS Application Support Centers overseen virtually by USCIS personnel using appropriate technology, notwithstanding any other provision of law. (Thus, USCIS may expand biometrics collection capacity without in-person oversight requirements at these centers, which support immigration benefit applications.)

This section directs the Federal Law Enforcement Training Accreditation Board—including representatives from the federal law enforcement community and non-federal accreditation experts involved in law enforcement training—to lead the federal law enforcement training accreditation process. The board is to continue implementing measures assessing the quality and effectiveness of federal law enforcement training programs, facilities, and instructors.

This section authorizes the Director of the Federal Law Enforcement Training Centers (FLETC) to accept transfers to its Procurement, Construction, and Improvements account from other government agencies requesting construction of special use facilities, as authorized by the Economy Act (31 U.S.C. 1535(b)). It requires FLETC to maintain administrative control and ownership of such facilities upon completion.

This section classifies the functions of Federal Law Enforcement Training Centers (FLETC) instructor staff as inherently governmental for purposes of the Federal Activities Inventory Reform Act of 1998 (FAIR Act; 31 U.S.C. 501 note). (Thus, these functions must be performed by federal employees and may not be outsourced to private contractors.)

This section authorizes the transfer of unexpended balances from prior appropriations for activities authorized by this Act to new appropriation accounts established under this Act, where such balances may be merged with funds in those accounts and accounted for as one fund for the original period of availability, subject to section 503.

This section prohibits the reprogramming of Department of Homeland Security (DHS) funds provided by the Act, prior appropriations acts, or fee collections available in FY2026 that (1) creates or eliminates a program, project, or activity or increases funding denied or restricted by Congress; (2) contracts out functions currently or proposed to be performed by federal employees; (3) augments existing programs, projects, or activities by more than $5 million or 10%, whichever is less; (4) reduces funding for any program, project, activity, or personnel by 10% or more; or (5) results from general personnel savings altering congressionally approved funding levels. Such prohibitions do not apply if the House and Senate Committees on Appropriations are notified at least 30 days in advance. This section authorizes transfers of up to 5% of DHS appropriations for the current fiscal year between such accounts with 30 days' notice to the Committees, provided no appropriation is increased by more than 10% by any such transfer. Notwithstanding the above, this section further prohibits all reprogrammings or transfers (1) based on notifications after June 15 except in extraordinary circumstances imminently threatening human life or property; (2) that increase or decrease funding for grant programs; or (3) that create new programs, projects, activities, functions, or requirements not approved by Congress. These restrictions apply to deobligated balances from prior DHS appropriations acts. This section authorizes the Secretary of Homeland Security to transfer up to $20 million from available DHS appropriations to the fund established by 8 U.S.C. 1101 note, with notification to the Committees at least 5 days in advance.

This section applies to funds appropriated by this Act the provisions of Section 504 of the FY2017 Department of Homeland Security Appropriations Act (division F of P.L. 115-31) governing operations of the Department of Homeland Security (DHS) working capital fund (i.e., a revolving fund that finances common administrative services such as IT, procurement, and financial management provided to DHS components on a reimbursable basis). It authorizes the obligation and expenditure of working capital fund amounts in anticipation of reimbursements from DHS components.

This section authorizes not to exceed 50% of unobligated balances remaining available at the end of FY2026 from “Operations and Support” appropriations provided in this Act—as recorded in financial records at the time of reprogramming notification, no later than June 15, 2027—to remain available through September 30, 2027, in the same account and for the same purposes. Prior to obligating such funds, the relevant agency must notify the House and Senate Committees on Appropriations in accordance with section 503 of this Act.

This section deems funds made available by this Act for intelligence activities as specifically authorized by Congress for FY2026, for purposes of section 504 of the National Security Act of 1947, until enactment of an Intelligence Authorization Act for FY2026. The section further requires excess amounts provided for Department of Homeland Security (DHS) "Intelligence, Analysis, and Situational Awareness—Operations and Support" above levels in such authorization act to be transferred to and merged with "Management Directorate—Operations and Support" funds. Prior to obligating transferred funds, the section directs the DHS Undersecretary for Management to brief the House and Senate Appropriations Committees on a plan for their use.

This section requires the Secretary of Homeland Security, or designee, to notify the House and Senate Appropriations Committees at least three full business days before (1) making or awarding a grant allocation or grant exceeding $1 million or a Disaster Relief Fund grant exceeding $100,000; (2) making or awarding a contract, other transaction agreement, task or delivery order on a multiple award contract, or letter of intent exceeding $2 million; (3) awarding a task or delivery order obligating more than $5 million from multi-year Department of Homeland Security funds; (4) making a sole-source grant award; or (5) publicly announcing an intention to take such actions. The section authorizes an exception without prior notice if compliance would pose a substantial risk to human life, health, or safety, requiring notification within three full business days after the action. Notifications must include the award amount, fiscal year and account of appropriated funds, and contract type, and may not involve unobligated funds.

This section prohibits federal agencies from purchasing, constructing, or leasing additional facilities for law enforcement training—except within or contiguous to existing locations—without advance notification to the House and Senate Appropriations Committees. It authorizes the Federal Law Enforcement Training Centers (FLETC) to obtain temporary use of additional facilities by lease, contract, or other agreement for training that cannot be accommodated in existing facilities.

This section prohibits the use of funds appropriated by this Act for any construction, repair, alteration, or acquisition project requiring a prospectus under 40 U.S.C. chapter 33 unless the prospectus is approved, except for necessary expenses to develop a proposed prospectus. (As background, prospectuses detail the scope, location, and estimated cost of major General Services Administration projects exceeding statutory thresholds, such as $3.8 million for public buildings, and require congressional committee approval prior to obligation of funds.)

This section applies sections 522 and 530 of the Department of Homeland Security Appropriations Act, 2008 (division E of Public Law 110-161), to funds made available by this Act in the same manner as those sections applied to funds made available under that Act.

This section prohibits the use of funds appropriated by this Act in contravention of the Buy American Act (i.e., chapter 83 of title 41, United States Code).

This section prohibits the use of funds appropriated by this Act to carry out the Department of Homeland Security (DHS) Secretary's reorganization authority under section 872 of the Homeland Security Act of 2002 (6 U.S.C. 452)—which allows the allocation or reallocation of functions and the establishment, consolidation, alteration, or discontinuation of organizational units, subject to limitations—unless explicitly authorized by Congress after enactment of this Act. The prohibition does not apply to the use of that authority (1) to allocate or reallocate functions of the Assistant Secretary for the Countering Weapons of Mass Destruction Office (CWMD Office)—DHS's office responsible for coordinating efforts to prevent WMD terrorism and proliferation—to other DHS offices and units consistent with the "Countering Weapons of Mass Destruction" table in the explanatory statement described in section 4 (in the matter preceding division A of this Act); or (2) to allocate or reallocate any other functions of the CWMD Office consistent with that table. (Thus, the provision effectively permits a specified reorganization of the CWMD Office.) Notwithstanding the prohibition, the Secretary may transfer funds made available in prior appropriations Acts to the CWMD Office between any DHS appropriations accounts as necessary to carry out those permitted reallocations.

This section prohibits any official required by the Act to report or certify to the House and Senate Committees on Appropriations from delegating that authority unless specifically authorized in the Act.

This section prohibits the use of funds provided by this Act for first-class travel by employees of agencies funded by this Act in contravention of 41 CFR 301-10.122 through 301-10.124 (i.e., Federal Travel Regulation requirements generally limiting first-class travel to approved exceptions such as medical necessity or unavailable coach service).

This section prohibits the use of funds appropriated by this Act to pay award or incentive fees for contractor performance judged to be below satisfactory or that does not meet basic contract requirements.

This section prohibits the use of funds provided by this Act to maintain or establish a computer network unless the network blocks the viewing, downloading, and exchanging of pornography. It exempts the use of such funds necessary for any federal, state, tribal, territorial, or local law enforcement agency or other entity carrying out criminal investigations, prosecutions, or adjudications.

This section prohibits the use of funds appropriated by this Act by a federal law enforcement officer to facilitate the transfer of an operable firearm to an individual known or suspected to be a drug cartel agent unless U.S. law enforcement personnel continuously monitor or control the firearm at all times.

This section prohibits the use of funds appropriated by this Act to pay for travel to or attendance at a single international conference (i.e., one outside the United States attended by U.S. government representatives and foreign governments, international organizations, or nongovernmental organizations) by more than 50 employees of a single Department of Homeland Security (DHS) component stationed in the United States, unless the Secretary or designee determines such attendance is in the national interest and notifies the House and Senate Appropriations Committees at least 10 days in advance with the basis for that determination. The section further limits total DHS costs for any such conference to $500,000 and excludes from these restrictions virtual attendees who do not travel from their permanent U.S. duty stations.

This section prohibits the Department of Homeland Security from obligating funds for any structural pay reform or new position classification affecting more than 100 full-time positions or costing more than $5 million in a single year until 30 days after the Secretary notifies Congress of (1) the number of positions affected, (2) funding required for the current fiscal year and Future Years Homeland Security Program, (3) justification for the change, and (4) for structural pay reforms, an analysis of compensation alternatives considered. The prohibition does not apply if the change was proposed in the President's budget for the fiscal year and funds for it have not been explicitly denied or restricted by the Act.

This section requires agencies receiving funds under this Act to post on their public websites any report required to be submitted to the House and Senate Committees on Appropriations by this Act, if the agency head determines posting serves the national interest and subject to exceptions for homeland or national security risks or proprietary information. Agencies must provide the committees at least 45 days' notice before posting (unless otherwise specified in law), and noncompliance suspends the agency's reprogramming and transfer authority under section 503 until the posting requirements are met.

This section authorizes funds appropriated in this Act for Operations and Support to be used for minor procurement, construction, and improvements, defined as end items with a unit cost of $250,000 or less for personal property and $4,000,000 or less for real property.

This section continues the authority under sec. 532 of the Department of Homeland Security Appropriations Act, 2018 (P.L. 115-141), for primary and secondary schooling of dependents of Department of Homeland Security personnel (i.e., in overseas or other locations lacking adequate schools), during FY2026.

This section prohibits the use of funds appropriated by the Act to place restraints on pregnant women or women in post-delivery recuperation in the custody of the Department of Homeland Security (DHS), including during transport, in a detention facility, or at an outside medical facility. Exceptions apply if (1) a DHS official determines the woman is a serious flight risk or poses an immediate and serious threat to herself or others that cannot be prevented by other means; or (2) a medical professional determines restraints are appropriate for the woman's medical safety. If restraints are used, they must be the safest and least restrictive as determined by the woman's treating medical professional; restraints are prohibited during active labor or delivery, in a face-down four-point position, on the back, or via a belt constricting the pregnancy area; and an immobilized pregnant woman must be positioned on her left side to the maximum extent feasible.

This section prohibits the use of funds provided by this Act to destroy any document, recording, or other record pertaining to (1) the death of, (2) potential sexual assault or abuse perpetrated against, or (3) an allegation of abuse, criminal activity, or disruption committed by an individual held in Department of Homeland Security (DHS) custody. The section requires such records to be made available, in accordance with applicable laws and regulations and federal rules governing disclosure in litigation, to an individual charged with a crime, placed into segregation, or otherwise punished as a result of an allegation described in (3), upon the request of such individual.

This section applies to any federal funds the prohibition on funding for any position designated as a Principal Federal Official, as provided in section 519 of division F of Public Law 114-113 (previously applicable only to funds made available by that Act).

This section requires the Under Secretary for Management of the Department of Homeland Security (DHS) to submit to the House and Senate Appropriations Committees, not later than 10 days after the President's annual budget submission, a report identifying unfunded priorities for DHS and each departmental component that would be funded under budget function 050 (national defense). For each priority—which by definition is an unfunded operational or contingency requirement that would have been budgeted if resources permitted, emerged since budget formulation, or sustains prior investments—the report must include (1) a summary description with objectives if funded; (2) a full description with objectives if funded; (3) appropriation account and program, project, or activity details; and (4) additional full-time or part-time positions required.

This section requires the Secretary of Homeland Security to notify congressional leadership and the appropriate congressional committees (i.e., Appropriations, Judiciary, Homeland Security, Homeland Security and Governmental Affairs, and Oversight committees of the House and Senate, as applicable) as follows: (1) within 10 days after the President determines to evaluate and initiate protection for a covered individual (i.e., a former or retired government official or employee, or an individual who will become such), including the threat assessment, scope of protection, and anticipated cost and duration; (2) at least 15 days before extending or 30 days before terminating such protection for a covered individual, including any change to the threat assessment; and (3) in a report due not later than 45 days after enactment and quarterly thereafter, detailing each covered individual, the scope, and associated cost of protection. All notifications and reports may be submitted in classified form, as necessary and in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation.

This section prohibits the Department of Homeland Security (DHS) from submitting an initial project proposal to the Technology Modernization Fund (TMF)—a fund that provides loans and grants to federal agencies for IT modernization projects—unless the agency head concurrently notifies the House and Senate Appropriations Committees, submits a copy of the proposal, and provides a detailed analysis of how the proposed funding supplements or supplants DHS's most recent budget request. It further prohibits obligation of TMF funds provided to DHS until 15 days after transmitting a report to the committees that includes (1) the full approved project proposal, (2) the finalized interagency agreement with deliverables and repayment terms, (3) an analysis of how the project supplements or supplants existing DHS funding, (4) a repayment plan with specific funding sources, and (5) other information as determined by the Secretary.

This section requires the Secretary of Homeland Security, within 60 days of any FY2027 budget submission that assumes revenues or proposes reductions from the prior year based on un-enacted user fee proposals, to provide the House and Senate Appropriations Committees with specific reductions in proposed discretionary budget authority equal to those assumed revenues, should the fees not be enacted by October 1, 2026.

This section prohibits the Department of Homeland Security (DHS) from using federal funds to enter into procurement contracts, memoranda of understanding, cooperative agreements, grants, loans, or guarantees with any entity identified under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (Public Law 116-283)—i.e., Communist Chinese military companies operating in the United States—or any subsidiary of such an entity. (As background, section 1260H requires the Secretary of Defense to annually identify such entities owned or controlled by the People's Liberation Army.)

This section prohibits the use of any appropriated funds to transfer, release, or assist in the transfer or release to or within the United States, its territories, or possessions, Khalid Sheikh Mohammed or any other detainee who (1) is not a U.S. citizen or member of the U.S. Armed Forces and (2) is or was held on or after June 24, 2009, at Naval Station, Guantanamo Bay, Cuba, by the Department of Defense.

This section directs the Secretary of Homeland Security, beginning immediately after enactment, to develop monthly estimates of anticipated migrant arrivals at the U.S. southwest border covering the current fiscal year and the following fiscal year, with breakouts by demographics (single adults, family units, and unaccompanied children). The estimates must undergo independent validation and verification; inform DHS policy planning and budgeting; and be included in budget materials submitted to Congress in support of (1) the President's annual budget request under 31 U.S.C. 1105, (2) any supplemental funding request, and (3) any reprogramming or transfer notification under section 503 of this Act. Such budget materials must include the most recent monthly estimates; a description and quantification of the estimates used to justify funding requests for DHS programs related to border security, immigration enforcement, and immigration services; a description and quantification of anticipated workloads and requirements; and confirmation that impacted agency budget requests used the same estimates. The section further requires the Secretary to share the monthly estimates with the Secretaries of Health and Human Services and State, the Attorney General, and the House and Senate Appropriations Committees; and suspends reprogramming and transfer authority under section 503 until the required estimates are provided to those committees if not included as specified.

This section requires the Secretary of Homeland Security to develop, on a monthly basis beginning immediately after enactment, estimates of the number of individuals anticipated to be detained in and removed from the United States. These estimates must (1) cover the current fiscal year and the following fiscal year; (2) include a demographic breakout for single adults and family units; (3) undergo independent validation and verification; (4) inform Department of Homeland Security policy planning and budgeting processes; and (5) be included in budget materials submitted to Congress supporting the President's annual budget request pursuant to 31 U.S.C. 1105, any supplemental funding requests, and reprogramming and transfer notifications under section 503 of this Act—such materials to include the most recent estimates, descriptions and quantifications justifying funding requests for border security, immigration enforcement, and immigration services programs; anticipated workloads and requirements; and confirmation that impacted agency budget requests used the same estimates. The Secretary must share the monthly estimates with the Attorney General, the Secretary of State, and the House and Senate Committees on Appropriations. Reprogramming and transfer authority under section 503 is suspended until the required estimates are provided to the Appropriations Committees if not included for the specified purposes.

This section requires the Secretary of Homeland Security, prior to requesting Department of Defense assistance for border security operations, to conduct an alternatives analysis and cost-benefit analysis that examines obtaining such support through other means. The section further requires the Secretary to submit a report to the House and Senate Committees on Appropriations within 30 days after making such a request detailing the types of support requested, the analyses conducted, and the operational impact to Department of Homeland Security operations; and, within 30 days after assistance is granted and quarterly thereafter through the duration of such assistance, an additional report detailing the assistance provided and its operational impacts on border security operations.

This section directs a transfer of not less than $5 million from funds made available in this Act to U.S. Immigration and Customs Enforcement (ICE) Operations and Support account for operations of the Blue Campaign (i.e., ICE's public awareness and training initiative to combat human trafficking) in FY2026. Prior to obligating these funds, ICE must notify the House and Senate Committees on Appropriations.

This section directs automatic reductions of $100,000 per day in funding for the Department of Homeland Security's Office of the Secretary and Executive Management—Operations and Support—Management and Oversight for specified failures by the Federal Emergency Management Agency (FEMA) related to the Disaster Relief Fund. Specifically, it (1) imposes the reduction if the monthly Disaster Relief Fund report required under the Department of Homeland Security Appropriations Act, 2015 (as applied in the current fiscal year by section 306 of this Act), is not submitted to the House and Senate Appropriations Committees and published on FEMA's website by the fifth business day of the applicable month; and (2) imposes the reduction during any period in which the number of reimbursement requests for individual assistance or public assistance related to Stafford Act emergency (42 U.S.C. 5122(1)) or major disaster (42 U.S.C. 5122(2)) declarations exceeds 500 under final review for more than 60 days. The reduction in (2) does not apply if the Disaster Relief Fund balance is sufficient only for lifesaving or life-sustaining activities.

This section extends the applicability of subsection (a) of Section 16005 of the CARES Act until September 30, 2026.

This section requires appropriation levels for classified programs specified in this Act to conform to the direction in the classified annex accompanying this Act and to be implemented consistent with section 545.

This section authorizes the Director of National Intelligence, with approval from the Secretary of Homeland Security and the Director of the Office of Management and Budget, to transfer funds within the National Intelligence Program consistent with the percentage caps in section 503(c). Such transfers are permitted only for higher-priority items based on unforeseen intelligence requirements—not for items denied by Congress—and require notifications consistent with section 503(d)(1).

This section requires the Department, within seven days of enactment of this Act and quarterly thereafter, to submit to the House and Senate Committees on Appropriations (1) an obligation plan by program, project, or activity for each component receiving funds from Public Law 119-21; (2) estimated fee collections for each component collecting new or enhanced fees authorized by Public Law 119-21, delineated by collections that a component will retain and collections that a component will remit to other agencies or the Treasury; and (3) an obligation plan by program, project, or activity for fee collections identified in paragraph (2) as being retained by a component within the Department.

This section prohibits the Department of Homeland Security from using appropriated funds to prevent Members of Congress or their designated House or Senate employees from entering, for oversight purposes, any DHS facility used to detain or house aliens, or to make temporary modifications at such facilities that alter observations compared to the absence of modifications. Members of Congress need not provide prior notice of intent to enter such facilities, while DHS may require a 24-hour advance request for designated employees.

This section appropriates $30 million for the Supreme Court of the United States—Salaries and Expenses account, to remain available until September 30, 2028, in addition to amounts otherwise available and subject to the same authorities and conditions as provided in the Financial Services and General Government Appropriations Act, 2026.

This section appropriates $140 million to the Department of Transportation-Federal Aviation Administration (FAA) Operations account for air traffic organization activities, to remain available until September 30, 2027. The funds may be used solely to provide a 3.8% pay rate increase for calendar year 2026 for air traffic controllers, as defined by 5 U.S.C. §2109(1)(A), and air traffic controller supervisors or managers not covered by that definition but who manage air traffic—but only to the extent the FAA Administrator determines, in his sole discretion, that improvements in workforce scheduling, staffing utilization, or other operational efficiencies have been achieved that address workforce shortfalls and enhance aviation safety (with any such increase effective the first pay period after January 1, 2026).

This section transfers $99,750,000 from unobligated balances appropriated to the Cybersecurity and Infrastructure Security Agency (CISA) Cybersecurity Response and Recovery Fund under division J of the Infrastructure Investment and Jobs Act (P.L. 117-58) to CISA's Operations and Support account. Transferred amounts continue to be treated as specified in section 103(b) of division A of P.L. 118-5.

This section rescinds $89,265,000 in unobligated balances from specified Department of Homeland Security accounts, excluding amounts designated by Congress as an emergency requirement pursuant to a concurrent resolution on the budget or the Balanced Budget and Emergency Deficit Control Act of 1985, as follows: (1) $73,327,000 from the Management Directorate—Procurement, Construction, and Improvements account; (2) $6,713,000 from the U.S. Customs and Border Protection—Operations and Support account; (3) $387,000 from the U.S. Customs and Border Protection—Automation Modernization account; (4) $917,000 from the U.S. Customs and Border Protection—Procurement, Construction, and Improvements account; (5) $6,336,000 from the U.S. Customs and Border Protection—Border Security Fencing, Infrastructure, and Technology account; (6) $1,413,000 from the U.S. Customs and Border Protection—Air and Marine Interdiction, Operations, Maintenance, and Procurement account; and (7) $172,000 from the Cybersecurity and Infrastructure Security Agency—Infrastructure Protection and Infrastructure Security account.

This section rescinds $111,744,895 in unobligated balances from specified Department of Homeland Security "Operations and Support" accounts appropriated under the Department of Homeland Security Appropriations Act, 2024 (as incorporated by the Full-Year Continuing Appropriations Act, 2025), as follows: (1) $2,072,147 from Office of the Secretary and Executive Management; (2) $5,487,177 from Management Directorate; (3) $4,493,650 from Intelligence, Analysis, and Situational Awareness; (4) $88,190 from Office of the Inspector General; (5) $1,139,096 from U.S. Customs and Border Protection; (6) $19,650,000 from Transportation Security Administration; (7) $703,390 from United States Secret Service; (8) $52,349,050 from Cybersecurity and Infrastructure Security Agency; (9) $18,525,975 from Federal Emergency Management Agency; (10) $120,860 from U.S. Citizenship and Immigration Services; (11) $178,340 from Science and Technology Directorate; and (12) $6,937,020 from Countering Weapons of Mass Destruction Office.

This section requires each covered immigration officer—defined to include U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement personnel and certain deputized individuals—to wear and operate a body-worn camera during any public immigration enforcement function (i.e., patrol, stop, arrest, search, interview on immigration status, raid, checkpoint inspection, or service of warrant; excluding covert operations). Video footage from such cameras must be retained by U.S. Immigration and Customs Enforcement for six months and then permanently deleted unless it captures use of force, events preceding or including an arrest for a crime, or an encounter subject to a complaint; extended retention of at least three years is required upon request by specified parties (e.g., involved officers asserting evidentiary value, subjects of the footage, or their guardians/next of kin) or for training purposes. The Secretary of Homeland Security must impose administrative discipline for noncompliance, submit annual reports to Congress and the Department's Office for Civil Rights and Civil Liberties detailing enforcement functions conducted, noncompliance instances, and remedial actions (with public versions posted online after potential redactions), and establish an independent advisory panel of experts to recommend policies on body camera use and footage management.

This section establishes identification requirements under new subsection (g) for covered immigration officers—i.e., U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) personnel, and those authorized under INA §287(g) (8 U.S.C. 1357(g)) or other Department of Homeland Security (DHS) agreements—conducting public-facing immigration enforcement functions (i.e., patrols, stops, arrests, searches, status interviews, raids, checkpoints, or warrant service, excluding covert operations), as well as for federal or non-federal law enforcement providing direct support. Such personnel must visibly display (1) a unique individual identifier (e.g., badge ID), (2) the employing entity's name, and (3) their face, except during (A) undercover operations using assumed identities, (B) planned tactical operations in high-risk situations (e.g., hostage incidents, terrorism response, narcotics raids), or (C) functions requiring face coverings under 29 C.F.R. §1960.10(b).

This section expands the definition of restricted personal information under 18 U.S.C. 119—which prohibits knowingly publicizing such information about certain protected individuals (i.e., federal officers and employees, jurors, witnesses, and state/local officials assisting federal investigations) with intent to threaten, intimidate, or facilitate a crime of violence against them or their immediate family—to include license plate number, biometric information, workplace address, school address, or global positioning system coordinates (in addition to existing items such as Social Security number, home address, home phone number, mobile phone number, personal email, or home fax number). It also directs the U.S. Sentencing Commission, by May 1 following the first full year after enactment, to amend the sentencing guidelines to treat an offense under that section committed against a law enforcement officer, or a member of such officer's immediate family, as an aggravating factor.

This section requires the FBI's Civil Rights Division to investigate each instance in which an immigration officer discharges a firearm while enforcing the immigration laws to determine whether the officer violated federal law, acted negligently, or violated applicable protocols. Upon completion, the FBI must submit its findings to the U.S. Attorney's Office for the district where the incident occurred and to the U.S. Attorney's Office for the District of Columbia.

This section directs the Secretary of Homeland Security, in enforcing immigration laws, to prioritize the detention and removal of aliens who pose a threat to public safety, including those suspected of committing a crime of violence (as defined in 18 U.S.C. 16(a)), and to coordinate with federal, state, and local law enforcement agencies on such prioritization. It further authorizes the Secretary to withhold, for each fiscal year of substantial noncompliance by a state or local law enforcement agency, up to 8 percent of the amount that would otherwise be apportioned to the state under the Emergency Management Performance Grants program (EMPG, 6 U.S.C. 762)—which provides grants to states to assist state, local, and tribal governments in all-hazards preparedness—for the first such fiscal year and up to 12 percent for each subsequent fiscal year.

This section directs the Secretary of Homeland Security to establish a required 5-month full-time training program for each immigration officer (as defined in INA §101(a)(18), 8 U.S.C. 1101(a)(18)) hired by U.S. Immigration and Customs Enforcement (ICE). It further requires any such officer hired before the date of enactment who did not complete a 5-month training program to complete the program not later than one year after such date.

This section directs the Secretary of Homeland Security to require all U.S. Immigration and Customs Enforcement (ICE) immigration officers to wear a standardized uniform when conducting a public immigration enforcement function, as defined in new INA §287(i) (8 U.S.C. 1357(i)). (INA §287 authorizes immigration officers to interrogate suspected aliens, make warrantless arrests for immigration violations under specified conditions, and board and search vehicles within proximity to U.S. borders.)

This section prohibits the arrest of an individual for a criminal violation of the immigration laws, as defined in section 101 of the Immigration and Nationality Act (8 U.S.C. 1101), without a warrant or probable cause.

This section prohibits civil immigration enforcement actions (i.e., non-criminal actions such as administrative arrests for removal) at sensitive locations without a warrant, except in exigent circumstances. Sensitive locations include all physical space within 1,000 feet of medical or mental health facilities; public and private schools (including preschools through universities), early childhood education sites, vocational schools, and workforce training sites; child care facilities (including centers, foster care, and group homes); places of worship; polling places on election day; privately owned personal residences; and other locations specified by the Secretary of Homeland Security. Exigent circumstances include (1) imminent risk of death, violence, physical harm, terrorism, or other national security threats; (2) immediate arrest or hot pursuit of an individual posing imminent danger to public safety; (3) rare premeditated arrests of terrorist suspects, national security threats, or extraordinary public safety dangers, with prior written approval of an authorizing official; (4) direct national security threats; or (5) imminent destruction of material evidence in a criminal case.
