H.R. 8213 — Defending Women in the Workplace Act

This section establishes a rule of construction providing that, for purposes of Title VII of the Civil Rights Act of 1964—which prohibits employment discrimination based on sex, among other protected characteristics—the terms “because of sex” and “on the basis of sex” do not include gender identity.
