H.R. 822 — POST IT Act of 2025

This section amends the website duties of the Small Business and Agriculture Regulatory Enforcement Ombudsman (i.e., the SBA official who receives small business comments on agency enforcement activities, refers substantiated issues to agency inspectors general, and reports annually to Congress) by adding a new paragraph (3) to subsection (e) requiring, to the extent practicable, hyperlinks to any agency guidance that sets forth policy on—or interprets—a statutory, regulatory, or technical issue for a rule requiring a small entity compliance guide (i.e., a plain-language guide that agencies must produce under the Small Business Regulatory Enforcement Fairness Act for major rules significantly affecting small entities). It further adds a new subsection (g) clarifying that these website requirements do not mandate public disclosure of information exempt under the Freedom of Information Act (5 U.S.C. 552(b)). These changes apply to small entity compliance guides produced on or after the date of enactment.
