H.R. 8230 — NO TOD Act

This section prohibits transit-oriented development projects from eligibility for assistance under the Transportation Infrastructure Finance and Innovation (TIFIA) program (i.e., projects or components designed for commercial or residential use), notwithstanding any other provision of law. (As background, the TIFIA program provides federal credit assistance—such as secured direct loans, loan guarantees, and lines of credit—for surface transportation projects of regional or national significance.) The section also strikes certain existing subparagraphs and clauses in 23 U.S.C. §§ 601(a)(12) and 602(a)(5)(B); makes a conforming amendment to § 608(a)(4); and applies to project applications submitted on or after enactment.

This section revises eligible purposes under the Railroad Rehabilitation and Improvement Financing (RRIF) program by striking subparagraph (b)(1)(F), which previously authorized direct loans and loan guarantees for economic development—including commercial and residential development and related infrastructure—that incorporated greater than 20% private investment, was physically connected to or within ½ mile of specified passenger rail or multimodal stations, and met construction and revenue-generation requirements. (As background, the RRIF program provides direct loans and loan guarantees to state and local governments, railroads, and related entities for rail equipment, facilities, and infrastructure improvements.) It also revises a priority category for loan applications by striking "and increase transit-oriented development" from subsection (c)(6), limiting it to projects that "improve railroad stations and passenger facilities." The amendments apply to applications submitted on or after the date of enactment.
