H.R. 8258 — Strategic Assets Protection Act

This section directs the Committee on Foreign Investment in the United States (CFIUS) to review all transactions completed on or after January 1, 2017, involving real estate, businesses, critical infrastructure, or assets located within, adjacent to, or functionally supporting facilities of the U.S. nuclear triad (i.e., intercontinental ballistic missile facilities, ballistic missile submarine bases and shipyards, strategic bomber bases, associated weapons storage areas, nuclear command, control, and communications infrastructure) or National Nuclear Security Administration production or research facilities. The review must assess national security risks posed by such transactions and determine whether mitigation measures, reopening of prior reviews, or recommendations to the President for action under section 721(d) of the Defense Production Act of 1950 (i.e., suspension, unwinding, or prohibition) are warranted. (Thus, the review applies retroactively to transactions potentially missed in initial CFIUS scrutiny.) The Secretary of the Treasury must submit a classified report on the review's findings and any actions taken or recommended to the House and Senate Appropriations and Armed Services Committees within 180 days of enactment, including an unclassified summary to the extent practicable.
