H.R. 8281 — Guard Equal Benefits for Federal Missions Act

This section establishes in new 32 U.S.C. §511 that full-time National Guard duty under 32 U.S.C. §502(f)—if (1) authorized by the President or Secretary of Defense, (2) performed in direct support of federal law enforcement operations coordinated with U.S. Immigration and Customs Enforcement, Drug Enforcement Administration, Bureau of Alcohol, Tobacco, Firearms and Explosives, or another agency designated by the Secretary, and (3) carried out to address significant criminal activity, drug trafficking, organized crime, or other public safety threats determined by the Secretary—counts as service in response to a national emergency for federal benefit eligibility. Qualifying service applies to (1) 10 U.S.C. §12731 (reduced retirement age), (2) 10 U.S.C. §1145 (Transitional Assistance Management Program, i.e., temporary health care for separating servicemembers), (3) 38 U.S.C. ch. 33 (Post-9/11 GI Bill education benefits), and (4) any other federal benefit tied to national emergency service. (Thus, eligible Guard members gain credit toward retirement, health care transition, education, and related benefits typically reserved for federal active duty in emergencies.)
