§3.Export control technical advisory committees
This section establishes technical advisory committees under the Export Control Reform Act of 2018 to advise the Secretary of Commerce on global technology supply chains, adversary threats (i.e., China, Russia, Iran, North Korea, Cuba, and certain others), export control parameters, licensing procedures, and emerging technologies. The Secretary must appoint committees for eight specified topics—(1) computing technologies and information systems (including semiconductors, microelectronics, artificial intelligence, and quantum computing); (2) biotechnologies; (3) automation (including robotics, advanced manufacturing, and autonomous systems); (4) aerospace and space technologies; (5) advanced materials; (6) weapons of mass destruction; (7) emerging and foundational technologies; and (8) regulations and procedures—with authority to create subcommittees and, beginning two years after enactment and in coordination with the Secretaries of State, Defense, and Energy, to review, adjust, or add committees to align with executive strategies (e.g., National Security Strategy, Critical and Emerging Technologies List). Membership of each committee must be equally divided among national security experts, relevant industry specialists, and academics, with three-year terms, mandatory nondisclosure agreements, and timely application processing; committees must meet at least every 120 days, with minutes submitted to specified congressional committees (i.e., House Foreign Affairs and Senate Banking) within 30 days; BIS must maintain a public webpage listing committees, members, and schedules; and each committee must submit annual assessments and recommendations on its topic to the Secretaries of Commerce, State, Defense, and Energy and the congressional committees.
