This section establishes a new federal criminal offense (18 U.S.C. §2249) for knowingly misrepresenting the nature or source of DNA used in assisted reproductive technology (ART)—including in vitro fertilization, gamete intrafallopian transfer, and zygote intrafallopian transfer—or assisted insemination (including intrauterine insemination), punishable by fine under title 18, United States Code, imprisonment for up to 10 years, or both, if conducted under specified interstate or foreign commerce circumstances (e.g., involving travel, payments, communications, or instruments moved in commerce). It further (1) tolls the statute of limitations for such offense until 10 years after DNA testing identifies the perpetrator; (2) designates the offense as racketeering activity under the Racketeer Influenced and Corrupt Organizations Act (RICO, 18 U.S.C. §1961(1)); and (3) updates the table of contents for chapter 109A of title 18, United States Code.
