This section prohibits funding under any applicable program to educational agencies or institutions that have a policy or practice of releasing education records or other student information—including personally identifiable information or directory information—for immigration enforcement purposes without written parental consent specifying the records or information to be released, the reasons for release, the recipient, and providing a copy to the parents and student if desired by the parents. (As background, §444 of the General Education Provisions Act, known as FERPA, generally protects the privacy of student education records from disclosure without consent. Thus, noncompliant schools risk losing federal education funding.)
