This section strikes all statutory references to socially disadvantaged farmers and ranchers (i.e., farmers and ranchers who are members of groups subjected to racial or ethnic prejudice or cultural bias) from multiple USDA programs, including the following: (1) In the Federal Crop Insurance Act (7 U.S.C. 1524(a)(3)), strikes subparagraph (C) on assistance priorities and redesignates remaining subparagraphs. (2) In the Agricultural Marketing Act of 1946 (§210A), strikes paragraphs and subclauses providing preferences or assistance; redesignates remaining provisions; and revises headings and text to reference only beginning and veteran farmers and ranchers. (3) In the Consolidated Farm and Rural Development Act (7 U.S.C. 1921 et seq.), strikes phrases, paragraphs, and preferences throughout §§304, 310B, 310E, 310F, 310I, 333B, and 352; revises §310I(d) to prioritize relending for heirs property owners in states adopting the Uniform Partition of Heirs Property Act; sets maximum homestead occupancy for prior owners at five years in §352(c)(4); and strikes entire §355 on farm ownership loans for such farmers. (4) In the Agriculture Improvement Act of 2018 (§5413), strikes references in urban agriculture provisions. (5) In the Food, Agriculture, Conservation, and Trade Act of 1990 (§2501), strikes definitions, outreach report requirements, priorities, and subsections (h) and (j) on assistance for socially disadvantaged farmers and ranchers; revises remaining text to reference only veteran farmers and ranchers; and redesignates subsections. (Thus, these changes eliminate targeted loan preferences, grant priorities, outreach programs, and other assistance for socially disadvantaged farmers and ranchers in farm credit, crop insurance, rural development, marketing, and urban agriculture programs.)
This section prohibits any Department of Agriculture program from providing preferences, priority consideration, or enhanced benefits to any individual or entity on the basis of race or gender, notwithstanding any other law.
