This section revises the reasonable pet requirements that public housing agencies may impose under the United States Housing Act of 1937 by— (1) authorizing pet deposits of up to 10% of a tenant's monthly base rent, amortized over not less than three months as part of rental payments, with any unused portion reimbursed within 30 days of tenancy termination; (2) prohibiting public housing agencies from withholding such deposits for damage unrelated to the pet, including ordinary wear and tear; (3) allowing limitations on the number of animals based on unit or building size or other conditions, prohibitions on species disallowed by state or local law, and bans on individual animals declared threats to public health and safety by a court or prohibited by state or local law; and (4) barring any prohibition based on an animal's breed, size, or weight.
