H.R. 8430 — Federal and State Food Safety Information Sharing Act of 2026

This section authorizes the Secretary of Health and Human Services, notwithstanding section 301(j) of the Federal Food, Drug, and Cosmetic Act (FFDCA), to share unredacted food safety information in the Food and Drug Administration's (FDA) possession with state, local, Tribal, and Territorial authorities performing comparable public health functions. Such information includes (1) foodborne illness surveillance data, (2) laboratory sampling and testing information, (3) inspectional information and results, (4) distribution lists for recalls and outbreaks, (5) consumer complaints, and (6) any other information the Secretary determines will assist public protection; requires sharing as soon as reasonably practicable; prohibits recipients from further disclosing the information without FDA permission unless necessary to contain an outbreak, conduct a recall, or perform enforcement activities; clarifies that the provision does not affect other information-sharing agreements; and makes a conforming amendment to section 301(j).

This section revises the grants to enhance food safety program (i.e., competitive grants to state, local, territorial, and tribal agencies to build capacity for food safety surveillance, outbreak response, and regulatory activities) by (1) extending the maximum grant period to 5 years (from 3 years) in subsections (d)(1) and (e), and (2) conditioning funding in subsequent years—where applicable—on a successful program evaluation by the Secretary after the first year, if conducted. The changes apply only to grants awarded on or after the date of enactment.
