H.R. 8432 — To provide the Food and Drug Administration needed authorities to carry out its regulatory mission with respect to human foods, to provide additional resources and authorities with respect to human foods research, and for other purposes.

This section expresses the sense of Congress that the Food and Drug Administration should establish a Human Foods Innovation Account to fund specified activities advancing food sector innovation. Those activities include critical research grants under section 4; a center of excellence under section 5; a public-private partnership under section 8; modernized standards for human foods (including for infants and young children), food safety, and supply chain continuity; advances in nutrition innovation; strengthened dietary supplement authorities; research on food biotechnology; modernized regulatory tools for chemicals in foods; modernized risk assessment; enhanced technical capacity; and other Commissioner-determined projects.

This section directs the Secretary of Health and Human Services to establish and maintain a permanent Advisory Committee on Human Foods, composed of experts on nutrition and food safety and representatives of consumer, producer, and health professional organizations, to advise the FDA Commissioner on issues related to food science, nutrition, and food safety.

This section establishes a competitive grant program administered by the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs and the Director of the National Institutes of Health, to promote research in critical areas including (1) food biotechnology; (2) nutrition initiatives to promote greater access to healthier foods and information about foods; (3) infant and maternal nutrition; (4) health impacts of ultra-processed foods; (5) safety and reliability of specialty foods such as infant formula; (6) health impacts of dietary supplements; and (7) public understanding of the risks and benefits of ultra-processed foods, dietary supplements, and other nutrition sources. The Secretary must prioritize projects fostering collaboration among a broad range of partners and may award grants to public or private nonprofit organizations with recognized capacity and expertise in those areas.

This section directs the Commissioner of Food and Drugs, acting through the Deputy Commissioner of Human Foods and the Director of the Center for Drug Evaluation and Research (CDER), to establish and maintain a center of excellence to improve nutrition science and its relation to medicine. The center must (1) coordinate Food and Drug Administration (FDA) programs and activities on areas of convergence between the Human Foods Program and CDER—including the rise of drugs for weight loss, medications to mitigate food allergies, nutrition's role in health alongside pharmaceuticals and physical activity, and medical-system programs such as produce prescriptions—and (2) serve as a platform for agency-wide collaboration on food-as-medicine research and innovation.

This section establishes an exemption from the Paperwork Reduction Act for the Food and Drug Administration's voluntary collection of information during the conduct of research.

This section establishes recordkeeping and disclosure requirements for processed foods under section 414(a) of the Federal Food, Drug, and Cosmetic Act by (1) requiring persons (excluding farms and restaurants) who manufacture, process, pack, distribute, receive, hold, or import processed food to provide FDA officers, upon request, access to records on recipes and contents—including labeled and nonlabeled ingredients, amounts of each ingredient, and relevant product authorizations; (2) requiring manufacturers (excluding farms and restaurants) of processed foods with undeclared contents (i.e., flavors, colors, spices, and incidental additives) to submit those contents to the FDA Commissioner, who must publish a list of such foods and contents on a website; and (3) expanding the applicability of existing record requirements to the new provisions. (Thus, FDA gains enforceable access to proprietary recipe details for processed foods, with certain nonlabeled ingredients becoming publicly available.)

This section directs the Commissioner of Food and Drugs to enter into a partnership with one or more nongovernmental entities—(1) to facilitate information sharing across industry, academia, and consumer groups about the composition, use, and long-term impacts of food packaging materials; and (2) to recommend appropriate limits for chemicals in food and food-contact substances. Not later than 18 months after entering the partnership, and annually thereafter, the Commissioner shall submit to Congress a report describing the partnership's completed and ongoing work.
