H.R. 8451 — Prevent the Misuse of Federal Law Enforcement Act

This section limits federal law enforcement authorities as follows: (1) restricts duties of Drug Enforcement Administration (DEA) enforcement personnel under the Controlled Substances Act to those designated by the Attorney General as necessary to enforce controlled substances laws and related solely to, arising from, or supplementing drug investigations; (2) prohibits the U.S. Marshals Service from deputizing state, local, tribal, territorial, or District of Columbia law enforcement officers—or other federal officers—absent a request from the chief executive of the relevant jurisdiction; and (3) bars the Secretary of Homeland Security from designating additional Department of Homeland Security employees as officers or agents for federal property protection in areas of protest activity without such a chief executive request (not applicable to employees transferred from the Federal Protective Service under the Homeland Security Act of 2002).
