This section prohibits the importation of nonhuman primates (i.e., any live member of the taxonomic order Primates other than Homo sapiens) into the United States, except for imports by and for placement with Association of Zoos and Aquariums (AZA)-accredited facilities where the importer certifies the primate will not be transferred, sold, leased, or provided for experiments, testing, or breeding for such purposes. U.S. Customs and Border Protection enforces the prohibition by denying clearance to prohibited shipments; violations are subject to civil penalties of up to $50,000 per violation and forfeiture of the primates to the United States. The Secretary of the Treasury must issue implementing regulations within one year of enactment.
