H.R. 8476 — No Antisemitism in Education Act of 2026

This section states congressional findings concerning antisemitism in the United States, particularly in educational institutions, as follows: (1) more than two-thirds of religiously motivated hate crimes target Jews per the most recent FBI data; nearly half of young American Jews were personally targeted in 2025; 42% of American Jewish college students experienced antisemitism on campus; and one in four was excluded from a campus group or event due to being Jewish; (2) an October 31, 2024, House Committee on Education and Workforce report documents universities' systemic failures to enforce policies equitably against antisemitism violating Title VI of the Civil Rights Act of 1964; (3) many institutions exhibit double standards in addressing antisemitism-motivated discrimination; and (4) a March 17, 2026, committee report shows ongoing failures by university leadership, faculty, and student groups.

This section requires local educational agencies and institutions of higher education, as a condition of receiving federal financial assistance, to treat discrimination motivated by antisemitism—including that by students or employees or resulting from institutional policies—as vigorously as other forms prohibited by Title VI of the Civil Rights Act of 1964 (i.e., discrimination based on race, color, or national origin). It directs federal departments or agencies, as well as such recipients of assistance, to consider the definition of antisemitism from Executive Order 13899 (including its contemporary examples) when identifying evidence, reviewing, investigating, or determining violations of relevant federal law based on discriminatory antisemitic intent. These requirements are enforceable through Title VI mechanisms and do not diminish First Amendment rights or preempt state antidiscrimination laws.
